Planning Commission Meeting Minutes
MARCH 1, 2007
The March 1, 2007 Planning Commission meeting was called to order by Chair
Swecker in the City Hall Council Chambers at 5:55 p.m.
Flag pledge and roll call of members:
Present: Manikowski, Davis, Swecker, Pattee, Grenz, Drotning, Ex-officio Gerl.
Absent: Stolte.
Staff Present: Daryl Morey, Planning Director; and Jay Rubash, Assistant City
Engineer.
ITEM 3. APPROVAL OF MEETING MINUTES:
The February 15, 2007 Planning Commission meeting minutes were approved as
presented.
ITEM 4. ANNOUNCEMENTS:
Mr. Morey stated that the following item was distributed to the Planning
Commission members and staff before tonight's meeting.
1. The February 28, 2007 Parks, Recreation and .Natural Resources
Committee meeting motion regarding the Thomas Meadows
preliminary and final plat.
Mr. Morey thanked the Planning Commission members for being present at
tonight's meeting considering the adverse weather conditions.
ITEM 5. SWEARING IN OF NEW PLANNING COMMISSION MEMBER BART DAMS
.Bart Davis was sworn in as a new Planning Commission member at tonight's
meeting. Chair Swecker welcomed Mr. Davis to the Planning Commission.
ITEM 6. THOMAS MEADOWS
Chair Swecker opened the public hearing to consider the application of Rongitsch
Properties for the following, located south of 175 Street and east of Jaguar. Path:
A. Zoning Map amendment to rezone the subject property from RS-2, Single Family
Residential District to RS-3, Single Family Residential District; B. Preliminary and
final .plat of five lots to be known as Thomas Meadows; C. Vacation of a street,
drainage, and utility easement. Planning Director .Daryl Morey attested that the
legal notice had been duly published in accordance with State Statutes and City
Code.

Steve Love from Jacobson Engineers and Surveyors presented an overview of their
request. Mike Rongitsch from Rongitsch Properties arrived at approximately 6:05
p.m. to answer any questions that the Planning Commission or public may have.
Planning Director Daryl Morey presented the planning report. Mr. Morey stated
that in conjunction with their request for a preliminary and final plat of five single
family lots to be known as Thomas Meadows, Rongitsch Properties has submitted
applications for rezoning the property from RS-2 Single Family Residential District
to RS-3 Single Family Residential District, as well as the vacation of a roadway
easement.
Mr. Morey indicated that staff supports rezoning the subject property to RS-3,
which would make this plat consistent with the surrounding area. He stated that
all lots meet the minimum lot area and width and building setback requirements of
the Zoning Ordinance for the RS-3 District.
Mr. Morey stated .that the Thomas Meadows development includes the
construction of Street A, which will be a cul-de-sac off of 175th Street. There will be
no driveway access allowed onto 175th Street.
• Mr. More stated that the existin easement alon 175th Street is requested to be

vacated as part of this development. He indicated that the easement will be
replaced with ROW dedication on the Thomas Meadows final plat.
Mr. Morey stated that the developer will construct buffer yard berming and
landscaping along 175th Street to the current Zoning Ordinance standards.
Mr. Morey stated that should the Planning Commission recommend to the City
Council approval of the Thomas Meadows rezoning, preliminary and final .plat,
and easement vacation, Planning Department staff recommends approval subject to
the 12 stipulations listed in the February 22, 2007 planning report, and approval of
the Findings of Fact dated March 1, 2007.
Chair Swecker opened the hearing to the public for comment.
Weldon (Whitey) Whitehouse, 9330176th Street W.
Concerns of Mr. Whitehouse:
? Not in favor of the rezoning.
? Noted that there are steep slopes on the south side of the property leading
• down to a wetland.
? With five driveways off of a short cul-de-sac street, felt there will be little
room for snow storage.
? Questioned the width of the cul-de-sac street.

? Felt there should have been more public notification/involvement. A
neighborhood meeting would have helped..
07.14 Motion was made and Seconded to close the public hearing at 6:08 p.m.

Chair Swecker likes the proposed development but the developer should have
hosted a neighborhood meeting as requested by staff. She indicated that the City
does a good }ob of informing the public of development proposals and
neighborhood meetings are one aspect of the public notification process.
Chair Swecker questioned the proposed cul-de-sac radius and the City's cul-de-sac
requirements. Mr. Rubash clarified the proposed cul-de-sac radius and the City's.
requirements. He commented that there is enough room for snow .storage along
the straight portion of the street. In the final design construction plans, Mr. Rubash
indicated that the radi of the curb will be slightly modified to make sure that the
snow plows can make it in and out of the cul-de-sac without having to back up.
Chair Swecker asked what the difference is between the RS-2 zoning versus the RS-
3 zoning for this property. Mr. Morey stated that the narrower lot width
requirement of the RS-3 District allows the developer to plat one more lot, but the
lot areas exceed the RS-3 District requirements.. He indicated that the proposed RS-
3 re-zoning is consistent with the zoning on both sides of 175 Street in this area.
He stated that .the developer. will be constructing a buffer yard berm and
landscaping, which the other lots along 175 Street in this area do not have because
they were platted prior to the City's buffer yard requirements.
Commissioner Manikowski questioned whether the required street .width was
different for RS-2 versus RS-3. Mr. Morey replied that there is no difference in the
street width requirement for RS-2 and RS-31ots.
Chair Swecker. questioned whether the 28 foot width proposed for the throat of the
cul-de-sac street would accommodate parking on both sides. Mr. Rubash stated
that typically the City restricts parking to only. one side of a 28 foot wide street.
The Planning Commission agreed that no parking on one side of the cul-de-sac
street should be added as a stipulation.
Commissioner Drotning felt the rezoning was appropriate and consistent with the
zoning. of the surrounding neighborhoods. He ,reiterated Chair Swecker's
. comments on the need for a neighborhood meeting for infill development
proposals.

Commissioner Drotning informed Mr. Rongitsch that it was inappropriate for him..
to remove significant trees from the subject property shortly before he submitted a
subdivision application with the City, thus .triggering the City's tree preservation
requirements. He strongly stated that Mr. Rongitsch keep the Planning
Commission s comments on tree preservation and neighborhood meetings in mind
if he plans to develop land in the city in the future.
07.15 Motion was made and Seconded to recommend to City Council approval of the
Thomas Meadows preliminary and final plat of five lots, located south of 175
Street and east of jaguar Path, Zoning Map amendment to rezone the subject
property from RS-2, Single Family Residential District. to RS-3, Single Family
Residential District, and vacation of a street, drainage, and utility .easement, subject
to the 12 stipulations listed in the February 22, 2007 planning report, with the
addition of Stipulation 13 to read: 13. One side of the cul-de-sac street throat shall
be designated as "No Parking", and approval of the Findings of Fact dated March
1, 2007.

There being no further business, the meeting was adjourned at 6:26 p.m.
