HomeMy WebLinkAbout05-03-07 -CITY OF LAKEVILLE Planning Commission Meeting Minutes • MAY 3, 2007 The May 3, 2007 Planning Commission meeting was called to order by Vice Chair Drotning in the City Hall Council Chambers at 6:00 p.m. .Flag Pledge. Present: Davis, Manikowski, Drotning, Pattee, Grenz. Absent: Swecker, Stolte, Ex-officio Gerl. Staff Present: Daryl Morey, Planning Director; Frank Dempsey, Associate Planner; Jay Rubash, Assistant City Engineer; Andrea Poehler, Assistant City Attorney; and Penny Brevig, Recording Secretary. ITEM 3. APPROVAL OF MEETING MINUTES: The April 5, 2007 Planning Commission meeting minutes were approved as presented. The April 19, 2007 Planning Commission work session notes were approved as presented. ITEM 4. ANNOUNCEMENTS: Mr. Morey indicated the following items were distributed to the Planning Commission members and staff before tonight's meeting. 1. The May 2, 2007 Parks, Recreation and Natural Resources Committee meeting minutes regarding the Autumn Meadows final plat. Mr. Morey reminded the Commissioners about the work session immediately following tonight's meeting in the Lake Marion Conference Room. ITEM 5. CONSENT AGENDA 07.28 Motion was made and seconded to recommend to City Council approval of the May 3, 2007 Planning Commission Consent Agenda as follows: Approve the request of Lorene Erickson for athree-year extension of a .Special Home Occupation Permit to operate a massage therapy use in her single family home, located at 17187 Jordan Court. Ayes: Davis, Manikowski, Drotning, Pattee, Grenz. • Nays: 0 Planning Commission Meeting May 3, 2007 Page 2 ITEM 6. AUTUMN MEADOWS Vice Chair Drotning opened the public hearing to consider the application of JMM Miller, Inc. for the vacation of a public drainage and utility easement in Autumn Meadows, located on property east of Flagstaff .Avenue at 179 Street; and to consider the final plat of 47 single family residential lots and 6 outlots to be known as Autumn Meadows. Assistant City Attorney Poehler attested that the legal notice .had been duly published in accordance with State Statutes and City Code. Bob Wiegert from Paramount Engineering & Design presented an overview of their request. Mr. Wiegert stated that Mr. Miller is requesting that he not be required to have Aquila vacate their. easement as a requirement of the final plat since there is a gas pipeline located within the easement that would be costly to relocate. Associate Planner Frank Dempsey presented the planning report.. Mr. Dempsey stated that the lot, block, and street design of the Autumn Meadows final plat. are consistent with the approved preliminary plat. He indicated that there are six outlots in the Autumn Meadows final plat, four of which will be owned and maintained by the developer and two of which will be deeded to the City. Mr. Dempsey stated that. an existing drainage and utility easement located in the northwest .corner of the property must be vacated with the final plat of Autumn Meadows. He indicated that the easement was acquired by the City from the previous property owner in 2003 for the purpose of accommodating public watermain installation. Mr. Dempsey stated that this. easement will be re- established with the Autumn Meadows final plat along the north boundary of Lot 1, Block 1. Mr. Dempsey stated that there is also a private easement in favor of Minnesota Energy Resources located on the east side of Flagstaff Avenue, which is the easement that Mr. Wiegert referred to. Because the gas pipeline located within this easement could interfere with trail construction or future widening of Flagstaff Avenue, Mr. Dempsey indicated that staff is recommending .that this easement be ..vacated. Mr. Dempsey indicated that Flint Avenue will continue to the south and ultimately be connected when the exception parcel is preliminary and final platted and the street connections are completed. As requested by the Planning Commission during their review of the Autumn Meadows preliminary plat at their April 5, 2007 meeting, the developer will be required to install a barricade at the existing terminus • Planning Commission Meeting May 3, 2007 Page 3 of Flint Avenue in the adjacent Kenridge development until the grading, streets and utilities construction for the Autumn Meadows final plat is completed. Mr. Dempsey stated that the landscape plan has been revised since preliminary plat approval to include a combination of staggered rows of evergreen trees and .deciduous trees along 179 Street and Flagstaff Avenue to provide the required screening as recommended by the Planning Commission at the April 5, 2007 meeting. He indicated the landscaped buffer design is consistent with the landscape design to the west in Crossroads. The landscape plan was also revised to include a staggered row of six foot tall spruce trees at the west end of the 179 Lane cul-de-sac to prevent headlight glare onto Flagstaff Avenue. Mr. Dempsey stated that should the. Planning Commission recommend to the City Council approval of the Autumn Meadows final plat and easement vacation, Planning Department staff recommends approval subject to the 17 stipulations listed in the Apri127, 2007 planning report. Vice Chair Drotning opened the hearing to the public for comment. . There were no comments from the audience. 07.29 Motion was made and seconded to close the public hearing at 6:11 p.m. -Ayes: 5 Nays: 0 Commissioner Grenz asked for clarification of the gas line easement. Mr. Rubash explained that the gas pipeline easement will be located within the Flagstaff Avenue right-of-way being dedicated with this final plat. The trail will be installed on top of the. gas pipe. He stated that the City is asking Mr. Miller to have the gas company vacate this easement and relocate the gas pipeline if necessary to avoid a conflict between the pipeline and Flagstaff Avenue trail and/or street improvements. 07.30 Motion was :made and seconded to recommend to City Council approval of the Autumn Meadows final plat of 47 single family residential lots and 6 outlots, located on property east of Flagstaff Avenue at 179 Street, and the vacation of a public drainage and utility easement, subject to the 17 stipulations listed in the April 27, 2007 planning report. Commission Work Session Thursday, May 3, 2007 Marion Conference Room The Planning Commission work session commenced at 6:30 p.m. in the Marion Conference Room at City Hall. Commissioners Present: Vice-Chair Drotning, Davis, Grenz, Manikowski, Pattee. Staff Present: Planning Director Daryl Morey, Assistant City Engineer Jay Rubash, and Planning Consultant Daniel Licht (NAC). Lake Marion Backwaters Reclassification Daniel Licht of NAC updated the. Planning Commission on the neighborhood meeting held on Monday, April 30, 2007, a summary of which is included in Mr. Licht's May 1, 2007 memo provided to commission members at tonight's work session. Staff also provided copies of the four follow-up a-mails received this week from property owners that were in attendance at the neighborhood meeting. Mr. Licht stated that the 13 property owners, not including the City, located within the shoreland overlay district for the backwaters portion of Lake Marion located west of I-35 and south of 185th Street (CSAH 60) that could potentially be affected by the lake • reclassification were mailed notice of the neighborhood meeting. Nine property owners representing six households attended Monday night's neighborhood meeting. Overall, the majority of property owners in attendance at the neighborhood meeting questioned the purpose behind the. proposed lake reclassification and expressed their strong opposition to the proposal because they feel it will place new restrictions on, and prevent future subdivision of, their properties. While acknowledging that their properties are not currently guided for City sanitary sewer service, the residents feel that their properties should be brought into the MUSA and guided for urban residential development in the near future as a natural progression of the development that has occurred in this area of the city since the 1998 Comprehensive Plan was adopted (i.e. Super Target/Timbercrest, Prairie Lake, the 1-35/CSAH 60 interchange improvements, and the widening ofi CSAH 60 to four lanes). The Planning Commission stated that the Comprehensive Plan has never planned urban development in the Lake Marion backwaters area and most property owners have no ability to subdivide under the 10 acre minimum lot size requirement for unsewered lots. The Planning Commission concurred with City staff's analysis that even if the Comprehensive Plan and Zoning Map were amended to allow urban residential development and City sanitary sewer was extended in this area, Dakota County access limitations on 185th Street (CSAH 60), existing wetlands and wetland protection requirements, and property line configurations would preclude most properties along Knollwood Circle from being subdivided. The Planning .Commission added that it is any property owner's responsibility to determine the potential to subdivide their property given the City's ordinance requirements. • Planning Commission Work Session Notes May 3, 2007 The Planning Commission agreed that this area is unique due to the extensive sensitive natural resources in the area including topography, wetlands, significant tree cover, characteristics of this portion of Lake Marion, and 185th Street access limitations. They felt that. increased density in this area should not be encouraged or allowed for these reasons. The commissioners reiterated that this area should remain guided and zoned for rural residential land uses through the 2030 planning timeframe of the 2008 Comprehensive Plan Update based on these factors and future population and land absorption projections. The commissioners stated that the lake reclassification will better secure the existing rural residential land use and zoning with the. goals and objectives of the Comprehensive Plan. The Planning Commission stated they had agreed at a previous work session that several land use/zoning changes resulting from input at the recent district neighborhood meetings could be processed prior to formal approval of the 2008 Comprehensive Plan Update. The. Lake Marion backwaters reclassification could also be processed at that time. The Planning Commission directed staff to continue communication with the 13 property owners and update them on the Planning Commission's discussion and direction to staff on the Lake Marion backwaters reclassification. The commissioners also directed staff to work with the DNR to minimize negative impacts on the 13 properties affected by the proposed lake reclassification, given the current shoreland overlay district requirements. Maintaining the current 100 foot setback to the OHWL as suggested by City staff as part of the proposed lake reclassification would minimize impacts for some of the 13 property owners by allowing house additions without the need for a variance.
