Planning Commission Meeting Minutes
NOVEMBER 6, 2008
The November- 6, 2008 Planning Commission meeting was called to order by Chair
Drotning in the City Hall Council Chambers at 6:00 p.m.

ITEM 3. APPROVAL OF MEETING MINUTES:
The October 16,..2008 Planning Commission meeting minutes were approved as
presented.
The October 16, 2008 Planning Commission work session notes were approved as
presented.
ITEM 4. ANNOUNCEMENTS:
Mr. Morey indicated that the following items were distributed to the Planning
Commission at tonight's meeting:
L Copy of the Recreation Vehicle Access Easement Agreement that is
being proposed to be vacated with Agenda Item 5.
2. Copy of a letter from All Parks Alliance for Change (APAC) regarding
Agenda Item 7.
Mr. Morey stated that there will be a brief work session in the Marion Conference.
Room immediately following tonight's meeting regarding the Spirit of Brandtjen
Farm Planned Unit Development (PUD).

ITEM 5. CITY OF LAKEVILLE
Chair Drotning opened .the public hearing to consider the request of the City of
Lakeville for the vacation of a permanent easement for recreation vehicle access
purposes, located at 8333 - 210 Street. The Recording Secretary attested that the
legal notice had been duly published in accordance with State Statutes and :City
Code.
Planning Director Daryl Morey presented. the October 29, 2008 planning report. He
stated that the property owner has requested the easement be vacated as it is no
longer needed given that the City's RV waste dump site has been moved to the
Water Treatment Facility. Mr. Morey stated that staff recommends approval of the
easement vacation, as presented in the October 29, 2008 planning report.
Chair Drotning opened the hearing to the public for comment.
There were no comments from the audience.
08.97 Motion was made and seconded to close the public hearing at 6:05 p.m.
Ayes: 5 Nays: 0
Chair Drotning asked for comments from the Planning Commission. .Chair
Drotning indicated that this was a fairly routine item. There were no comments
from the Planning Commissioners.
08.98 Motion was made and seconded to recommend to City Council approval of the
recreation vehicle access easement vacation, located at 8333 - 210 Street, as
presented.
Ayes: Glad, Lillehei, Drotning, Pattee, Davis.
Nays: 0
ITEM 6. CITY OF LAKEVILLE
Chair Drotning opened the public hearing to consider the following amendments to
the Lakeville City Code: A. Title 10, the Subdivision Ordinance, Chapter 4 (Design
Standards), and B. Title 11, the Zoning Ordinance, Chapter 6 (General. Performance
Standards) and Chapter .101 (FP, Floodplain Overlay District). The Recording
Secretary .attested that the legal notice had been duly published in accordance with
State Statutes and City Code.

Assistant City Engineer. Zach Johnson presented the October 29, 2008 staff report.
He stated that State Statute requires local government units (LGUs) to adopt official
controls to bring local water management -into conformance with the watershed
plan in order to retain its permitting authority. Mr. Johnson stated that staff
recommends approval of the amendments as presented in the October 29, 2008 staff
report.
Chair Drotning opened the hearing to the public for comment.
There were no comments from the audience.
08.99 Motion was made and seconded to close the public hearing at 6:11 p.m.
Ayes: 5 Nays: 0
Chair Drotning asked for comments from the Planning Commission. Discussion
points were:
• Definition of water courses as it pertains to this ordinance amendment. Mr.
Johnson stated that it is defined by the Vermillion River Watershed Stream
Classifications and Buffer Standards .Map adopted by the VRWJPO on
October 26, 2006.
• Page 14 of the amendment to the Subdivision Ordinance should be amended
to reference the October 26, 2006 map date.
08.100 Motion was made and seconded to recommend to City Council .approval of the
following amendments to the Lakeville City Code, as presented: A. Title 10, the
Subdivision Ordinance, .Chapter 4 (Design Standards), and B. Title 11, the Zoning
Ordinance, Chapter 6 (General Performance Standards) and Chapter 101 (FP,
Floodplain Overlay District), as amended.

ITEM 7. CITY OF LAKEVILLE
Chair Drotning opened the public hearing to consider the City of Lakeville 2008
Comprehensive Plan. The Recording Secretary .attested that the legal notice had
been duly published in accordance with State Statutes and City Code.
Associate Planner Allyn Kuennen presented an introduction of the 2008
Comprehensive Plan and explained the process to date since work commenced in
January, 2007.

Dan Licht from Northwest Associated Consultants presented the October 31, 2008
planning report. He gave a PowerPoint presentation which included the purpose
of the 2008 Comprehensive :Plan and indicated that the Planning Commission and
City Council have made community participation and input a significant priority in
the preparation of the 2008 Lakeville Comprehensive Plan. Mr. Licht stated that
staff recommends approval of the City of Lakeville 2008 Comprehensive Plan, as
presented.
Chair Drotning opened the hearing to the public for comment.
Garry Krebs, 18885 Knollwood Circle
• Wanted to know why the west bay of Lake Marion is proposed to be
reclassified from a Recreational Development Lake to a .Natural
Environment Lake. He does .not think that .the west bay of Lake Marion
meets the criteria for a Natural Environment Lake and he feels the `DNR is
pressuring the City into reclassifying the west bay of Lake Marion.
Jann DeGrammont, 16345 Jamison Path and a spokeperson for MICAH
• Reiterated the comments made in MICAH's letter to Mr. Morey, dated
October 27, 2008, which was included in the planning packet for tonight's
meeting, regarding how Lakeville needs to continue to encourage low cost
housing. and workforce housing.
Robert Erickson, 18224 Justice Way
• Mr. Erickson was a volunteer on behalf of a large institutional landowner
who appreciates the public process that is involved with the Comprehensive
Plan.
• Responded to Ms. DeGrammont's and MICAH's comments regarding low
income housing by identifying projects where Lakeville has been a leader in
partnering on affordable (work force) housing projects.
Richard Carron, 17555 Kodiak Avenue
• Commented on the past River City Asphalt mining activities in the City,
which provided considerable savings on City improvement projects. He
indicated that the River City Asphalt gravel mine is located near I-35 and
205 Street u1 the 2015 MLJSA, but will be ready for development in 2010.

The Planning Commission agreed that the public hearing .will stay open through
the Planning Commission discussion.

The Planning Commission and staff responded to the public comments. Discussion
points were:
• Clarified what qualifies as a Natural Environment Lake.
• Explanation of -the process of how the City decided to reclassify the west bay
of Lake Marion from a Recreational Development Lake to a Natural
Environment Lake.

• Recommended modifying the pertinent sections of the 2008 Comprehensive
Land Use Plan to state that the reclassification of the west bay of Lake
Marion to a Natural Environment Lake will be "considered" with the Zoning
.Ordinance Update.
• Discussion regarding where and how much land is designated for medium
or high density land uses on the 2030 Land Use Plan.
• Recommended toning down the language on Page 92 of the Comprehensive
Plan where it states, "However, the loss of Local Government Aid and cuts
to MVHC funds. hinder the City's affordable housing efforts."
• Discussed why. the majority of the River City Asphalt mining area is in the
2015 MUSA.

Chair Drotning and the Planning Commissioners thanked staff for all their .hard
work on the 2008 Comprehensive Plan and being so open and assessable to the
public.
There was a discussion of the next step in the process for approving the 2008
Comprehensive Plan. Mr. Morey indicated that the 2008 Comprehensive Plan will
be submitted to the Metropolitan Council by mid-December and work on updating
the Zoning Ordinance and Zoning Map will start in January, 2009.

08.102 Motion was made and seconded to recommend to City Council approval of the
City of Lakeville 2008 Comprehensive Plan, as amended.
Ayes: Pattee, Davis, Glad, Lillehei, Drotning.
Nays: 0
There-being no further business, the meeting was adjourned at 8:50 p.m.
The Planning Commission proceeded immediately into a work session.
