HomeMy WebLinkAbout24-065 Approval of Kenyon Green Preliminary Plat CITY OF LAKEVILLE DAKOTA COUNTY, MINNESOTA RESOLUTION NO. 24- ((SC�� RESOLUTION APPROVING THE PRELIMINARY PLAT OF KENYON GREEN WHEREAS, the Ron Clark Construction has requested approval of the preliminary plat of 15 townhome lots, one townhome common area lot, and one apartment lot to be known as Kenyon Green,legally described in Exhibit A;and WHEREAS, the Planning Commission held a public hearing at its June 6, 2024 meeting, preceded by notice as required by the Subdivision Ordinance; and WHEREAS, the Planning Commission recommended approval of the preliminary plat; and WHEREAS, the preliminary plat meets Subdivision Ordinance requirements and is acceptable to the City; NOW,THEREFORE, BE IT RESOLVED by the Lakeville City Council: The Kenyon Green preliminary plat is hereby approved subject to the following conditions: 1. Implementation of the recommendations listed in the May 22, 2024 engineering report. 2. Park dedication shall be satisfied with a cash contribution paid at the time of final plat approval. 3. The developer shall construct a pedestrian path between the Kenyon Green development and 185`''Street (CSAH 60). 4. Outlot A shall be deeded to the City with the final plat. 5. The attached townhomes must meet the exterior materials requirements of the Zoning Ordinance. 6. A shared driveway and access easement shall be established over Lots 1 and 2, Block 1, Kenyon Green. 7. The developer shall submit dimensioned floor plans for the attached townhome units to verify compliance with the minimum requirements for above grade floor area established by the Zoning Ordinance. 8. Each attached townhome unit shall include an attached garage meeting the minimum width and area requirements of the Zoning Ordinance. 9. A homeowner's association and maintenance covenants shall be established for ownership and maintenance of the common area townhome lots. A homeowners association and declarations for buildings, common area, property maintenance and easements for driveway and common areas shall be established for Lots 1-17, Block 2, of the Kenyon Green preliminary plat in accordance with Minnesota State Statute. The association declarations shall be reviewed and approved by the City Attorney prior to recording of the final plat with Dakota County. Prior to sale of any lot within Block 2, the approved homeowners association documents shall be filed with the Minnesota Secretary of State's office and recorded with Dakota County, as appropriate. Lot 1, Block 2, shall be deeded to the homeowner's association. ADOPTED by the Lakeville City Council this 17�h day of June 2024. CITY OF LAK VIL E BY: e M.
