HomeMy WebLinkAbout12-01-08 CITY OF LAKEVILLE COUNCIL MEETING MINUTES DECEMBER 1, 2008 Mayor Dahl called the meeting to order at 7:00 p.m. The pledge of .allegiance to the flag was given. Present: Mayor Holly Dahf Council Member Mark Bellows Council Member Kerrin Swecker Council Member Wendy Wulff Council Member Laurie Rieb Also Present: Roger Knutson, City Attorney Steve Mielke, City Administrator Tom Vonhof, Police Chief Keith Nelson, City Engineer Dennis Feller, Finance Director Daryl Morey, Planning Director. Steve Michaud, Parks & Recreation Director Chris Petree, Operations & Maintenance Director Charlene Friedges, City Cierk Mr. Mielke had no additional agenda information. Presentations/Introductions Chris Petree presented the November monthly report of the Operations 8~ Maintenance Department. Citizens' Comments None Consent Agenda 08.104 Motion was made by Bellows, seconded by Rieb to approve the consent agenda items as follows: a. Claims. for payment. b. Ordinance No. 849 amending Title 7 of the Lakeville City Code adopting the Dakota County uniform street naming and addressing .system. e. America's VEBA Solution Basic Plan Document and Adoption Agreement effective January 1, 2009. f. Resolution No. 08-167 establishing rules and rental fees for use of -City shelters/buildings. g. Resolution No. 08-168 establishing rules and rental fees-for use of City, athletic facilities. h. State of Minnesota/Department of Natural Resources Subgrant Agreement under the Federal Recreational Trail Program Project Agreement for the cross-country ski trails assistance grant-in-aid ..program. i. Resolution No. 08-169 amending the Lakeville Fire Relief Association By-Laws. j. Receive Lakeville Convention and Visitors. Bureau financial statements for the year ending December 31, 2007. k. Ordinance No. 850 amending Title 7 of the Lakeville City Code concerning water service. Roll call was taken on the motion. Ayes, unanimous. - Item 7 - 2008 Comprehensive Plan Associate Planner Allyn Kuennen presented the 2008 Comprehensive Plan, which consists of the Land Use Plan, Transportation Plan, Sanitary Sewer Plan, Water Plan, Storm Water Plan and the Park, Trails and Open Space Plan. The Park, Trails and Open. Space Plan was approved by the City Council in 2006. The Sanitary Sewer Plan, Water Plan and Storm CITY OF LAKEVILLE COUNCIL MEETING MINUTES DECEMBER 1, 2008 Page 3 Water Plan were previously reviewed by the City Council. The. Transportation Plan has been revised to include a chapter regarding transit service, and the Land Use Plan has been revised as directed by the Planning Commission, He stated the 2008 Comprehensive Plan update will refine existing plans and extend the City's development framework to 2030. Dan Licht of Northwest Associated Consultants provided a detailed overview of the 2008 Comprehensive Plan. He explained that the plan will be submitted to the Metropolitan Council for review and adoption. The Metropolitan Council has 60 days from the date of submission to review the plan, with the option to extend that review period by an additional 60 days. Council Member Wulff expressed concerns with the proposed medium- density land use in the Argonne Farms neighborhood given the existing wetlands and topography in that area. Mr. Kuennen explained staff and the Planning Commission determined that medium-density residential was the most appropriate transition between the existing commercial (Argonne Village) adjacent to County Road 50 and the single-family residential to the east. Council Member Wulff stated, because the area is environmentally sensitive, she would like to see if remain single-family residential until a specific proposal for the development of that property comes forward and the boundaries for medium-density zoning are more clearly defined. Mr. Morey pointed out that a property owner can apply for an amendment to the Comprehensive Plan at any time. He also provided a history of the property proposed to be guided medium density residential, which vvas, at one time, zoned commercial but was rezoned to single family residential at the request of the property owners approximately 10 years ago. He cited Brunswick Zone as a recent example of commercial development located adjacent to single family homes with no land use buffer. Mr. Kuennen explained that three property owners in the area proposed to be guided medium density residential requested a higher land use as part of the public input process for the 2008 Comprehensive Plan due to the adjacent Argonne Village commercial development. CITY OF LAKEVILLE COUNCIL MEETING MINUTES DECEMBER 1, 2008 Page 4 Mr. Licht stated that with the standards Lakeville has in place in terms of tree preservation, wetland buffering and other site plan controls, there wilt be an intensive review of whatever development occurs in that area.. He .recommended the Council approve the 2008 Comprehensive Plan as presented. Mr. Mielke suggested freezing the existing land use and designating this area as a special study area on the 2030 Land Use Map, to be studied cooperatively with all of the affected property owners. He pointed out than any land use or zoning changes to this special study area could not. take place until after the 2008 Comprehensive Plan is approved by the Metropolitan Council 08.105 Motion was made by Wulff, seconded by Bellows to approve Resolution No. 08-171 approving the 2008 Comprehensive Plan, with the use of the properties east of the Argonne Village development to remain as designated on the current 2020 Land Use Map and establishing a special study area to further refine the land uses in the area east of Argonne Village. Roll call was taken on the motion. Ayes, unanimous. Item 8 -Dakota County CDA Redevelopment Planning Grant Program Mr. Olson presented a resolution approving submittal of a Dakota County Community Development Agency Redevelopment Planning Grant Program application for planning activities in Pioneer Plaza and the adjacent downtown parking area. The application is fora $15,000 ' matching grant. If the application is approved, the City would be required. fo match the grant, with $5,000 coming from the Park Dedication Fund and the remaining $10,000 provided from an economic development funding source. The Downtown Lakeville Business Association has submitted a letter of support for the City's application. .08.106 Motion was made by Swecker, seconded by Wulff to approve Resolution No. 08-172 approving submittal of a Dakota County Community Development Agency Redevelopment Planning Grant Program application for Pioneer Plaza and the adjacent downtown parking area.
