RESOLUTION NO. 25- 0719
RESOLUTION APPROVING THE PRELIMINARY PLAT
OF HERITAGE COMMONS 9TH ADDITION
WHEREAS, The Architects Partnership requests approval of the preliminary plat
of two commercial lots to be known as HERITAGE COMMONS 9TH ADDITION; and
WHEREAS, the Planning Commission held a public hearing at its May 8, 2025
meeting, preceded by notice as required by the Subdivision Ordinance, and unanimously
recommended approval; and
WHEREAS, the preliminary plat meets Subdivision Ordinance requirements; and
WHEREAS, the preliminary plat is acceptable to the City.
NOW THEREFORE BE IT RESOLVED by the Lakeville City Council:
The HERITAGE COMMONS 9TH ADDITION preliminary plat is approved subject to the
following conditions:
1. Implementation of the recommendations listed in the April 25, 2025 engineering
report.
2. The site shall be developed according to the plans approved by the City Council.
3. Execution of a Stormwater Maintenance Agreement shall be required between
Chase Bank and the City of Lakeville for the maintenance of the stormwater basin
located on Lot 1, Block 1, Heritage Commons 9th Addition.
4. An agreement for shared driveway access shall be established between Lots 1 and 2,
Block 1, Heritage Commons 9th Addition and Lot 1, Block 1, Heritage Commons
81h Addition (Tires Plus) in conjunction with the recording of the final plat.
5. The trash enclosure must have a durable maintenance -free gate.
6. Any rooftop and/or ground -mounted mechanical equipment must be screened per
Zoning Ordinance requirements.
7. The City Forester has reviewed and approved the landscape plan dated May 1, 2025.
Landscaping on site must be installed per the approved plan. Prior to a landscape
inspection, an as -built landscape plan must be submitted to the city.
S. A cost estimate for the installation of the approved landscaping shall be submitted
prior to City Council consideration of the final plat.
9. Exterior lighting shall be down -cast only and shall not glare onto road right-of-way.
10. Snow storage shall not occur within required parking spaces.
11. Prior to City Council consideration of the final plat, drainage and utility easements
must be added along the side property lines of each parcel.
ADOPTED by the Lakeville City Council this 191 day of May 2025.
