JULY 28, 1997
The meeting was called to order at 7:30 a.m. by Mayor Zaun. Roll call was
taken. Present: Councilmembers Johnson, Sindt, Mulvihill and Mayor Zaun.
Absent: Councilmember Holberg.
Mr. Erickson presented a proposed ordinance which would allow the City to
post a no-wake zone on Lake Marion due to high water levels. He explained
that due to continuous rainfall, the Lake Marion water level is above the
established level of 983.6. Last Friday, the Public Works and Police
Department personnel considered implementation of a no-wake zone on the
entire lake to minimize impact to surrounding property. Staff was able to get
DNR support for enforcement of the no-wake zone over the weekend, and
notices were distributed to all Lake Marion homeowners. Mr. Erickson
explained that the review process by the DNR typically takes several weeks;
however, the DNR is expected to respond immediately to this emergency
request. The ordinance was drafted by City Attorney Roger Knutson and is
consistent with an ordinance recently adopted by the City of Burnsville for
Crystal Lake.
Mayor Zaun asked about aircraft using the lake. Chief Martens stated the
ordinance only refers to watercraft.
97.131 Motion was made by .Mulvihill, seconded by Sindt to adopt Ordinance No.
605, an emergency ordinance amending Title 7 of the Lakeville City Code
concerning water surface usage, regulating operation of watercraft on Lake
Marion.
Rolf call was taken on the motion. Ayes, Johnson, Zaun, Sindt, Mulvihill.
Mayor Zaun adjourned the meeting at 7:40 a.m.
