RESOLUTION NO. 26-024
RESOLUTION APPROVING GRANT OF EXCLUSIVE
PERMANENT UTILITY EASEMENT, ACCESS AND PARKING EASEMENT,
AND TEMPORARY CONSTRUCTION EASEMENT TO
MINNESOTA ENERGY RESOURCES COROPORATION
WHEREAS, the City of Lakeville owns certain real property legally described on Exhibit A
attached to the Easement Agreement; and
WHEREAS, Minnesota Energy Resources Corporation has requested an exclusive, permanent
utility easement, a non-exclusive access and parking easement, and a temporary construction
easement across said property for the purpose of constructing,operating,and maintaining privately
owned utility facities; and
WHEREAS,the City Council finds that granting such easements will not interfere with the City's
use of the property and is in the public interest; and
WHEREAS, Minnesota Statutes authorize the City Council to convey interests in real property
by resolution.
NOW,THEREFORE, BE IT RESOLVED,by the City Council of the City of Lakeville:
1. The City Counci] hereby approves the grant of an exclusive,permanent utility easement, a
non-exclusive access and parking easement, and a temporary construction easement to
Minnesota Energy Resources Corporation across the property described in Exhibit A,
substantially in the form of the Easement Agreement attached hereto as Exhibit 1.
2. The Mayor and City Clerk are authorized and directed to execute the Easement Agreement
and any related documents on behalf of the City.
3. City staff is directed to ensure the Easement Agreement and all exhibits are properly
recorded with the Dakota County Recorder's Office.
ADOPTED by the Lakeville City Council this 16`�' day of March 2026.
