RESOLUTION NO.26-095
RESOLUTION APPROVING GRANT OF PERMANENT EXCLUSIVE
EASEMENT TO VERIZON WIRELESS
WHEREAS, the City of Lakeville owns certain real property legally described as Lots 1, 2, 3, 4, 7, 8,
9, 10, 11, 12, 13, 14, 15, 16, 17, and 18, Block 3, Fairfield, and Lots 11, 12, 13, 14, 15, 16, 17, and 18,
Block 6 Fairfield, Dakota County, Minnesota, according to the recorded plat thereof ('Property"); and
WHEREAS, Verizon Wireless has requested a permanent, exclusive easement over a portion of the
Property to install a small cell wireless facility; and
WHEREAS, the City Council finds that granting such easement will not interfere with the City's use
of the Property and is in the public interest; and
WHEREAS, Minnesota Statutes authorize the City Council to convey interests in real property by
resolution.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Lakeville:
1. The City Council hereby approves the grant of a permanent, exclusive easement across the
Property as described in Exhibit A, substantially in the form of the Easement Agreement
attached hereto as Exhibit 1.
2. The Mayor and Deputy City Clerk are authorized and directed to execute the Easement
Agreement and any related documents on behalf of the City.
3. City staff is directed to ensure the Easement Agreement and all exhibits are properly recorded
with the Dakota County Recorder's Office.
ADOPTED by the Lakeville City Council this 3`d day of August 2026.
