Preliminary and Final plat and PUD development stage plans of one commercial lot to be known as Spirit of Brandtjen Farm Commercial 8th Addition. 2. Vacation of public drainage and utility easements. October 7, 2026 Goodwill Easter Seals Real Estate LLC have submitted an application for a preliminary and final plat for a one lot commercial subdivision and PUD development stage plan to be known as Spirit of Brandtjen Farm Commercial 8th Addition. The applicant is also requesting vacation of public drainage and utility easements for the development of a retail building. The plat is 1.95 acres in area. The subject property is currently an outlot within the Spirit of Brandtjen Farm (SBF) commercial area and is zoned PUD, Planned Unit Development. The property is located south of 160th Street (CSAH 46) and east of Pilot Knob Road. The SBF Commercial 8th Addition preliminary and final plat and site development plans have been reviewed by Dakota County Plat Commission, Engineering and Environment Resources Division, as well as the City Forester. Easement Vacations The SBF Commercial 8th Addition property is located in Planning District 3, Northeast Lakeville, and is guided for commercial uses in the 2040 Comprehensive Land Use Plan. The proposed commercial use is consistent with the commercial designation of the Comprehensive Land Use Plan. The SBF Commercial 8th Addition property is zoned PUD, Planned Unit Development District. The SBF PUD was approved in 2005. The SBF Land Use Plan, attached as Exhibit C, guides the SBF development for mixed use based on the uses allowed in the O-R, Office/Residential Transition District and the C-3, General Commercial District. The proposed retail building is consistent with the SBF Land Use Plan. North – CSAH 46 and Townhomes (Apple Valley) South – Hy-Vee (PUD District) East – Valvoline (PUD District) West – Wings Credit Union and Freddies (PUD District) No public street construction or other public funded infrastructure construction is proposed with the SBF Commercial 8th Addition plat. All streets, sanitary sewer, water and storm sewer improvements required for the area of the SBF Commercial 8th Addition were installed by the developer with the SBF Commercial development in 2015. The SBF Commercial 8th Addition plat proposes one lot on one block. The SBF PUD District does not require minimum area or width for lots being platted. The subject site is 85,014 square feet in area (1.95 acres) and is 219 feet wide. The site is proposed to be accessed by a private drive that extends across Outlot A, SBF Commercial 1st Addition, extending east-west to Elmhurst Drive. No new public street construction is proposed with this plat. Existing sidewalks will be extended along the south property line to provide pedestrian access through the development. 3 Grading, Drainage, Erosion Control, and Utilities. Grading, drainage and erosion control plans have been submitted with the SBF Commercial 8th Addition preliminary plat. Assistant City Engineer and Environmental Resources have reviewed the site, grading, drainage and erosion control, and utility plans. A copy of the engineering report dated August 13, 2026 is attached for your review. The Engineering Division recommends approval of the preliminary and final plat subject to the recommendations outlined in the report. There are no significant trees located on the subject property. There are no wetlands located on the subject property. Lot 1, Block 1 as shown on the preliminary and final plat is subject to park dedication requirements at the time of final plat approval. The park dedication requirements will be met as a cash fee in lieu of land at $5,400 per acre for commercial uses in accordance with the SBF Master PUD Agreement. The subject site is 1.95 acres in area, which calculates as a park dedication cash fee of $10,530. SITE P LAN Use. Goodwill is proposing a 20,839 square foot, single level retail building with a drive through donation center. The SBF PUD uses the C-3, General Commercial District as the base zoning for the SBF Commercial Area, which allows 10-foot setbacks to side or rear property lines not adjacent to public right of way. The proposed building is setback 15 feet from the east and west property lines, in compliance with the setback requirements. The C-3 district requires a 30-foot building setback from the north property line, along CSAH 46. The proposed building is setback 47 feet, complying with code requirements. The proposed 20,839 square foot building requires 83 parking spaces, taking into account the allowable 10% gross floor area credit and the requirement for one parking space per 225 square feet of floor area. The site plan proposes 97 parking spaces south of the building. The proposed parking spaces and drive aisle dimensions and configurations comply with the requirements of the Zoning Ordinance. Parking aisles will be 24 feet in width and parking stall dimensions will be nine feet in width and 18 feet in length, which is permitted when the space accommodates two feet for a vehicle overhang and 20 feet in length when there is no overhang space. Snow storage may not occur within required parking spaces. Access to the site will be from the private drives along the east and west sides of the site. No direct driveway access to primary east-west private drive is proposed. The landscape plan proposes overstory trees along south side of the site, foundation plantings on the east side of the building, and plantings at the drive entrances. The City Forester has reviewed the landscape plan dated July 8, 2026 and noted that screening is required along 160th St./CSAH 46. A line of shade trees planted with 40ft spacing with 4 Honeylocust and/or Kentucky coffee tree is recommended. A revised landscape plan is required to be submitted and approved prior to the plat going to City Council. Remaining areas will be sodded and in-ground irrigation installed. The Developer must provide a security to be paid at the time of final plat to guarantee installation of the landscaping. Prior to a landscape inspection, an as-built landscape plan must be submitted to the city. The proposed building height is 20 feet with one entrance having a façade totaling 24 feet in height, which complies with Zoning Ordinance requirements. The proposed building is subject to the exterior finish requirements outlined by Section 11-17-9.D.1 of the Zoning Ordinance. The exterior finish of the building must utilize a minimum of three Grade A materials listed in Section 11-17-9.B of the Zoning Ordinance or brick for a minimum of 65 percent of the area of the building elevation. The remaining building materials may be Grade B or C as defined in Section 11-17-9.B of the Zoning Ordinance for up to 35 percent of the wall area, or Grade D materials for up to 10 percent of the wall area. The primary exterior building materials are two different colors of brick. Brick and glass/windows, make up 65% of the building’s exterior materials. The remainder of the building is Grade C EIFS (31-42%). The exterior materials are currently not in compliance as Grade C materials exceed 35% of the wall area. The building elevations shall be revised to be in compliance with City Code prior to building permit approval. Per Section 11-18-11 of the Zoning Ordinance, the trash/recycling/compactor receptacles for commercial uses shall be enclosed and fully screened from view of adjacent properties. The applicant shall provide a screening detail to be approved by the zoning administrator prior to building permit. Signs shown on the building elevations are for illustrative purpose only. The building is subject to the sign allowances applicable within the C-3 District established by Section 11-23-19.E of the Zoning Ordinance. For principal buildings with a gross floor area less than 45,000 square feet the total area of all wall signs shall not exceed 200 square feet for corner or through lots and the maximum area of any one individual wall sign shall not exceed 100 square feet. A sign permit is required to be issued prior to the installation of any signs on site. No light source or combination thereof which casts light on a public street shall exceed one foot-candle meter reading as measured at the right of way or property line. All building mounted lighting must face downward onto the structure. . All rooftop and/or ground-mounted mechanical equipment must be screened per Zoning Ordinance requirements. Snow storage may not take place in required parking spaces. 5 EASEMENT VACATION Existing easements are proposed to be vacated concurrent with the approval of the final plat. The proposed plat includes perimeter drainage and utility easements. All proposed easements are subject to review and approval of the City Engineer. RECOMMENDATION The proposed PUD Development Stage Plan for Goodwill and the preliminary and final plat approval of Spirit of Brandtjen Farm Commercial 8th Addition is consistent with the SBF Land Use Plan and the requirements of the SBF PUD District, Zoning Ordinance, and Subdivision Ordinance. Community Development Department staff recommends approval of the Spirit of Brandtjen Farm Commercial 8th Addition preliminary and final plat, PUD Development Stage Plan and easement vacations, subject to the following stipulations: 1. Implementation of the recommendations listed in the August 13, 2026 engineering report. 2. The site shall be developed according to the plans approved by the City Council. 3. All rooftop and/or ground-mounted mechanical equipment must be screened per Zoning Ordinance requirements. 4. A financial security shall be submitted to guarantee installation of the approved landscaping. 5. Park dedication as a cash in lieu fee, in accordance with the SBF Master PUD Agreement, must be paid at the time of final plat approval. 6. Exterior lighting shall have a 90-degree horizontal cutoff, shall be limited to a height of 35 feet or less and in compliance with Section 11-16-17 of the Zoning Ordinance. 7. Snow storage shall not occur within required parking spaces. 8. Building elevations shall be revised to comply with Section 11-17-9 of the Zoning Ordinance. 9. All trash/recycling/compactor receptacles for commercial use shall be enclosed and fully screened from view of adjacent properties. The applicant shall provide a screening detail to be approved by the zoning administrator prior to building permit. 10. Additional landscaping is required along the north property line and must be approved by the City Forester prior to final plat approval. Landscaping on site must be installed per the approved plan. The stormwater management requirements for the parent parcel were satisfied through stormwater management basins constructed with Spirit of Brandtjen Farm Commercial 2nd Addition through an assumed impervious surface coverage of 85% for the site. The privately-owned and maintained storm sewer will be located within Lot 1, Block 1 and will collect and convey stormwater runoff generated from within the development to the private storm sewer system within the private roadways. Draintile construction is required in areas of non-granular soils for the street sub-cuts and lots. Any additional draintile construction, including perimeter draintile required for building footings, deemed necessary during construction by the City shall be the Developer’s responsibility to install and finance.
