RESOLUTION NO. 26-105
RESOLUTION ADOPTING A RECORD OF DECISION FOR THE FINAL
ALTERNATIVE URBAN AREAWIDE REVIEW (AUAR)AND MITIGATION PLAN
FOR THE SOUTHWEST STUDY AREA
WHEREAS, THE LAWS OF THE State of Minnesota allow for a local unit of government to
use the Alternative Urban Areawide Review (AUAR) instead of the Environmental Impact
Statement (EIS)to review anticipated residential, commercial, warehousing, and light industrial
development and associated infrastructure in a particular geographic area within its jurisdiction
(Minnesota Rules 4410.3610 Subp. 1); and
WHEREAS, the Southwest Study Area AUAR ("Project") evaluated two development scenarios
where Scenario 1 is consistent with the adopted comprehensive plan, and Scenario 2 is consistent
with a developer's concept plan and considers mixed residential, commercial, institutional, parks,
open space, and storniwater management areas in the AUAR Area of 390.4 acres; and
WHEREAS, the Project is within the City of Lakeville ("City"), exceeds the thresholds of a
mandatory EIS, and the City selected an AUAR as the appropriate environmental review process,
and
WHEREAS, the Project is required to provide a Scoping Document as an additional procedure
to the review process due to the size of the anticipated development(Minnesota Rules
4410.3610, Subpart Sa); and
WHEREAS, an AUAR Scoping Document was prepared for the Project, reviewed by the City
Council, and the document was circulated for comments to the required state and federal
agencies, as provided by law; and
WHEREAS, a notice of availability of the AUAR Scoping Document was published in the EQB
Monitor on October 21, 2025, and the thirty-day comment period expired on November 20,
2025, and during such period seven comment letters were received from agencies, and no
comments were received from residents; and
WHEREAS,the Final Order and response to comments documents were prepared in response to
comments received during the comment period, applicable changes were incorporated into the
AUAR Scoping Document, and documents were reviewed by City Council; and
WHEREAS, the City Council is required by law to make a finding on the adequacy of the
AUAR Scoping Document and to adopt the Final Order and Record of Decision; and
WHEREAS, the City Council ordered the preparation of the Draft AUAR and identified two
scenarios for study,per Resolution No. 25-151 on December 1, 2025; and
WHEREAS, a Draft AUAR was prepared for the Project and reviewed by the Ciry Council, and
the document was circulated for comments to the required state and federal agencies, as provided
by law; and
WHEREAS, a notice of the availability of the Draft AUAR was published in the EQB Monitor
on May 12, 2026, and the thirty-day comment period expired on June 11, 2026, and during such
period, four comment letters were received from agencies, and eleven comment letters or emails
were received from residents; and
WHEREAS, the Final AUAR document was prepared for the Project and reviewed by City
Council and the document was circulated for comments to the required state and federal
agencies, as provided by law; and
WHEREAS, the City Council is required by law to adopt a Record of Decision for the adequacy
of the Final AUAR; and
WHEREAS, to remain valid as a substitute form of review, the environmental analysis
document and the plan for mitigation must be revised if any of the circumstances in Minnesota
Rules 4410.3610, Subpart 7, items A through H apply; and
WHEREAS, the City Council met at a regularly scheduled meeting on August 17, 2026, and
considered the Final AUAR, City Staff reports, and comments received; and
WHEREAS, nothing in this adoption of the Final AUAR should be interpreted in any way to
suggest that the City approves of future applications related to the Project.
NOW,THEREFORE, BE IT RESOLVED by the City Council of the City of Lakeville,
Minnesota that the City Council hereby adopts the Final AUAR and Mitigation Plan for the
Southwest Study Area.
