HomeMy WebLinkAbout26-106 Resolution Approving the Preliminady Plat of Highview CITY OF LAI�VILLE DAKOTA COUNTY,MINNESOTA RESOLUTION NO.26-106 RESOLUTION APPROVING THE PRELIMINARY PLAT OF HIGHVIEW WHEREAS, Lennar has requested approval of the preliminary plat of 34 single-family lots and four outlots to be known as HIGHVIEW, legally described as: Parcel 1: Commencing at the Southeast corner of Section 20; thence Westerly a distance of 475 feet along section line;thence North a distance of 175 feet; thence East parallel with said section line a distance of 475 feet to Easterly line of said Section; thence South along Easterly line a distance of 175 feet to point of beginning, all in Section 20, Township 114, Range 20, Dakota County,Minnesota. Parcel2: The South Half of the Southeast Quarter of the Southeast Quarter of Section 20, Township 114, Range 20, Dakota County,Minnesota, EXCEPTING a parcel commencing at the Southeast corner of Section 20;thence Westerly a distance of 475 feet along section line; thence North a distance of 175 feet;thence East parallel with said section line a distance of 475 feet to Easterly line of said Section; thence South along Easterly line a distance of 175 feet to point of beginning, all in Section 20, Township 114, Range 20, Dakota County,Minnesota. Parcel 3: Outlot C, Heritage Walk, Dakota County,Minnesota. WHEREAS, the Planning Commission held a public hearing at their August 6, 2026 meeting, preceded by notice as required by the Subdivision Ordinance; and WHEREAS, the Planning Commission unanimously recommended approval of the preliminary plat; and WHEREAS, the preliminary plat is acceptable to the City; NOW THEREFORE BE IT RESOLVED by the Lakeville City Council: HIGHVIEW preliminary plat is approved subject to the following conditions: 1. Implementation of the recommendations listed in the July 22, 2026 engineering report. 2. Park dedication shall be satisfied with a cash contribution paid with the final plat. 3. The Developer shall construct five-foot-wide concrete sidewalks as required by city code. 4. Outlots B &C shall be deeded to the City with the final plat. 5. Driveway access from Lot 1, Block 1 to Holyoke Avenue is prohibited. 6. A security is required to be submitted with the final plat to guarantee installation of the buffer yard landscaping 7. A $1,000 cash escrow must be submitted with the building permit application for Lot 1, Block 1 to guarantee installation of the buffer rear yard sod to the trail along Holyoke Avenue. 8. The undeveloped public right of way stub north of Heritage Drive, adjacent to Outlot C, Heritage Walk, must be vacated prior to City Council consideration of the final plat. 9. The City will coordinate a meeting with the property owner directly north of the plat to review the final plat plans prior to the final plat going to City Council.
