Planning Commission Meeting Minutes
APRIL 6, 2006
The Apri16, 2006 Planning Commission meeting was called to .order by Chair
Swecker in the City Hall Council Chambers at 6:00 p.m.
Flag pledge and roll call of members:
Present: Pattee, Manikowski, Stolte, Swecker, Detjen, Grenz, Drotning, Ex-officio
Gerl.
Absent: None.
Staff Present: Daryl Morey, Planning Director; Allyn Kuennen, Associate Planner;
Kristine Jenson, Associate Planner; Jay Rubash, Assistant City Engineer; Andrea
Poehler, Assistant City Attorney; and Penny Brevig, Recording Secretary.
ITEM 3. APPROVAL OF MEETING MINUTES:
The March 23, 2006 Planning Commission meeting minutes were approved as
presented.
ITEM 4. ANNOUNCEMENTS:
Mr. Morey indicated the following items were distributed to the Planning
• Commission members and staff before tonight's meeting.
1. Apri15, 2006 Parks, Recreation and Natural Resources Committee
meeting motion regarding the Crescent Ridge Second Addition
preliminary plat. Mr. Morey stated that the motion will be revised to
state: "A ten foot wide trail is to be construction on the east side of
Holyoke Avenue..."
Mr. Morey introduced Kristine Jenson as the City's .new Associate Planner.
Mr. Morey indicated that under Agenda Item 9 he wants to discuss the May, 2006
Planning Commission meetings and different scheduling options due. to the Taste
of Lakeville being held on May 4, the regularly scheduled Planning Commission
meeting date.
ITEM 5. BELLANTE SECOND ADDITION
Chair Swecker opened the public hearing to consider the application of William
Feldman for the preliminary and final plat of 53 townhome lots and four common
area lots to be known as Bellante Second Addition, located north of 185 Street
(CSAH 60) and east of Judicial Road. Assistant City Attorney Poehler attested that
the legal notice had been duly published in accordance with State Statutes and City
Code.

T'he developer of Bellante Second Addition has requested that the Planning
Commission. table the public hearing for Bellante Second Addition preliminary and
final plat to allow him additional time to prepare modifications to the proposed
preliminary and final plat plans.
06.26 Motion by Detjen, Second by Pattee to continue the public hearingfor the Bellante
Second Addition preliminary and final plat.
Ayes: Pattee, Manikowski, Stolte, Swecker, Detjen, Grenz, Drotning.

ITEM 6. MARK FINHOLT AND ROCKY SELLERS
Chair Swecker opened the public hearing to consider the application of Mark
Finholt and Rocky Sellers for the vacation of a public drainage and utility easement
and pond and drainage easement, located at 16394 Klamath Trail. Assistant City
Attorney Poehler attested that the legal notice had been duly published in
accordance with State Statutes and City Code.
. Mark Finholt was in attendance at tonight's meeting to answer any questions that
the .Planning Commission. or public may. have. Mr. Finholt presented an overview
of his request.
Planning Director Daryl Morey presented the planning report. Mr. Morey stated
that Rocky .Sellers and Mark Finholt have submitted applications for an
administrative subdivision and the vacation of existing drainage and utility and
pond and drainage easements on property located at 16394 Klamath Trail, which is
within the Shoreland Overlay District of Lake Kingsley.
Mr. Morey stated that the existing boundary drainage and utility easements are
substandard and. that the existing pond and drainage easement does not entirely
cover the portion of the wetland located within the parent parcel. He indicated that
the proposed plan will provide 10 foot wide boundary drainage and utility
easements and a new drainage, utility and conservation easement over and above
the existing wetland and wetland buffer located within the parent parcel.
Mr. Morey indicated that there is currently a single family home and a number of
non-conforming outbuildings and fences on the property. He indicated that the
non-conformities will be removed with the administrative subdivision and
• easement vacation. Mr. Morey stated that the administrative subdivision requested
by the applicants in conjunction with the easement vacation will allow the
construction of a new single family home on the south side of .the existing parcel.

He stated that if the City Council approves the vacation of the easements as
proposed, staff will support an administrative subdivision of the property into two
parcels as shown on the survey.
Mr. Morey stated that should the Planning Commission recommend to the City
Council approval of the easements, Planning Department staff recommends
approval subject to the 7 stipulations listed in the March 31, 2006 planning report.
Chair Swecker opened the hearing to the public for comment.
There were no comments from the audience.
06.27 Motion by Pattee, Second by Stolte to close the public hearing at 6:15 p.m.
Ayes: Manikowski, Stolte, Swecker, Detjen, Grenz, Drotning, Pattee.
Nays: 0
Commissioner Grenz. questioned whether Klamath Trail was a county road. Mr.
Morey stated that it is no longer a county road, but is classified as a major collector.
He indicated that given the topography of the property, staff recommends that the
• existing driveway access onto Klamth Trail be allowed to remain where it is
currently located.
Commissioner Drotning asked about the public hearing related to this proposed
development. Mr. Morey indicated that a public hearing is required for the
easement vacation, but not the administrative subdivision. This proposed
subdivision into two lots is allowed by the Subdivision Ordinance to be approved
administratively, which does not require a public hearing.
There was a discussion regarding the location of the proposed accessory building
on Parcel B. The Planning Commission also discussed the slope and grade of the
property.
06.28 Motion by Manikowski, Second by Drotning to recommend to City Council.
approval of the vacation of the drainage -and utility easement and pond and
drainage easement, located at 16394 Klamath Trail, subject to the 7 stipulations
listed in the March 31, 2006 planning report.
Ayes: Stolte, Swecker, Detjen, Grenz, Drotning, Pattee, Manikowski.

ITEM 7. CRESCENT RIDGE SECOND ADDITION
Chair Swecker opened the public hearing to consider the application of
LaFavre/Miller Development Company for the preliminary plat of 75 lots to be
known as Crescent Ridge. Second Addition, located north of 195 Street, east of
Holyoke Avenue and south of 190 Street. Assistant City Attorney Poehler attested
that the legal notice had been duly published in accordance with State Statutes and
City Code.
Kevin Thein and Joe Miller from LaFavre/Miller Development were in attendance
at tonight's meeting to answer any questions that the Planning Commission or
public may have. Mr. Thein presented an overview of the project.
Associate Planner Allyn Kuennen presented the planning report. Mr. Kuennen
stated that LaFavre/Miller Development has submitted a preliminary plat
application for the development of 75 lots to be known as Crescent Ridge Second:
Addition.
Mr. Kuennen stated that a Comprehensive Plan amendment to bring the northeast
corner of the subject property into the current MUSA and to re-guide the northeast
corner of the property from rural to low. density residential, and a rezoning of the
northeast corner of the subject property from RA District to RS-3 District will be
processed with the final plat application.
Mr. Kuennen stated that because the first addition preliminary plat and ghost plat
were submitted prior to the changes to the buffer yard standards, the .project is
subject to the buffer yard requirements listed in the Zoning Ordinance prior to
January 17, 2006. He indicated what the landscape plans show for buffer yard trees
and stated that the developer meets the required 10 foot high buffer yard screening
requirement along Holyoke Avenue and 195 Street.
Mr. Kuennen stated that access for Crescent Ridge Second Addition will be from
two points off Holyoke Avenue and from .the extension of 195 Street. He
indicated that the access points off Holyoke Avenue will include left and right turn
lanes.
Mr. Kuennen stated that the proposed .preliminary plat indicates the realignment of
Holyoke/Highview Avenue. He indicated that the realignment will provide longer
and safer curve radiuses on Holyoke Avenue and will allow the .current. off-set
intersection of 190 Street at Holyoke Avenue to be aligned as a standard
intersection. Mr. Kuennen indicated thaf the existing roadway .easement for
i Holyoke/Highview Avenue will remain in place until the realignment is fully
constructed and .open to traffic. The. easement for the old portion of

Holyoke/Highview Avenue that is no longer necessary will be vacated at the time
Outlot D is developed.
Mr. Kuennen stated that the developer will fully construct Holyoke and Highview
Avenues through the site as a four-lane parkway with a 10 foot wide bituminous
trail on the east side this year and complete the .north and south connections in
2007.. He indicated that the developer will need to maintain access for. the existing
residents while theroad improvements are completed. Mr. Kuennen stated that no
costs associated with the road improvement will be assessed to the existing
residents. He stated that all internal local streets will have five foot wide concrete
sidewalks on one side. 195 Street .will have a five foot wide concrete sidewalk
constructed on the south side.
Mr. Kuennen stated that park. dedication requirements are to be satisfied as a cash
fee in lieu of land as required by the Subdivision Ordinance. He indicated that this
was subject to review by the Parks, Recreation and Natural Resources Committee at
their April 5, 2006 meeting. Their motion has been distributed to the Planning.
Commission at tonight's meeting.
Mr. Kuennen stated that should the Planning Commission. recommend to the City
. Council approval of the Crescent Ridge. Second Addition. preliminary plat, Planning
Department staff recommends approval subject to the 18 stipulations listed in the
March 31, 2006 planning report.

06.29 Motion by Drotning, Second by Stolte to close the public hearing at 6:45 p.m.

The Planning Commission and staff responded to the public's questions and
. concerns.
Mr. Kuennen stated that Dakota County names the City's streets under their
Uniform Street Naming and Addressing System. He indicated that the County is
proposing to rename existing 195th Street to 196th Street/196th Court.
Regarding the evergreen trees on Mr. Nelsons .property, the Engineering
Department has worked with the developer to design the Holyoke Avenue
relocation to maximize the distance from. the road to the trees. Mr. Rubash
indicated that the east edge of realigned Holyoke Avenue will be approximately 50
feet from the evergreen trees.
Mr. Rubash stated that City water is being extended along existing 195th Street to
the east plat boundary line. .Abutting residents can connect to this. waterline.
Water will also be stubbed to the east plat boundary line on Harrapa Avenue, Halo
Avenue, and new 195th Street. He stated that abutting property owners east of the
plat should work with the developer regarding grading concerns along the shared
property lines.
City staff stated that the existing MUSA boundaries were established with the 1998
Comprehensive Plan Update.. Proposed Comprehensive Plan (MUSA)
• amendments are considered on their individual .merits. The amendments must be
approved. by both the City Council and the Metropolitan Council. In this instance,
the MUSA boundary is being adjusted to follow the parent property lines and the

portion of the property being brought into the Current MUSA (approximately 15
acres) can be served by gravity sanitary sewer.
Mr. Rubash stated that 190th Street will not be paved at this time. and sanitary sewer
and water will not be extended along 190th Street east of the plat. He also indicated
that during construction, a temporary road will be maintained along existing 195th
Street until the new road is built to provide access for current residents.
Mr. Morey stated that the developer is not. responsible for paving the temporary
cul-de-sac on the east end of existing 195th Street. Paving this cul-de-sac would be a
City responsibility to be decided by the City Council, not the Planning Commission.
Commissioner Detjen confirmed with staff that there would likely not be a north-
south roadway constructed along the east boundary of this plat at a future date.
The Planning Commission discussed the two access points shown on the
preliminary plat off of Holyoke Avenue and agreed that the accesses as proposed
were acceptable.
06.30 Motion by Drotning, Second by Pattee to recommend to City Council approval of
the Crescent Ridge Second Addition preliminary plat of 75 lots, located north of
195th Street, east of Holyoke Avenue and south of 190th Street, subject. to the 18
.stipulations listed in the March 31, 2006 planning report.
Ayes: Detjen, Grenz, Drotning, Pattee, Manikowski, Stolte, Swecker.
Nays: 0
ITEM 9. STAFF NOTICES
The Planning Commission concluded that the May 4, 2006 Planning Commission
meeting will be rescheduled for Tuesday, May 2, 2006 at 6:00 p.m.
There being no further business, the meeting was adjourned at 7:40 p.m.
