May 2, 2006 Planning Commission meeting was called to order by Chair Swecker in the City Hall Council Chambers at 6:00 p.m. Flag pledge and roll call of members: Present: Pattee, Manikowski, Stolte, Swecker, Detjen, Grenz, Drotning, Ex-officio GerL Absent: None. Staff Present: Daryl Morey, Planning Director; Leif Hanson, Assistant Planner; Jay Rubash, Assistant City Engineer; Andrea Poehler, Assistant City Attorney; and Penny Brevig, Recording Secretary. ITEM 3. APPROVAL OF MEETING MINUTES: The ...April 20, 2006 Planning Commission meeting minutes were approved as presented. ITEM 4. ANNOUNCEMENTS: Mr. Morey indicated the following items were distributed to the Planning • Commission members and staff before tonight's meeting. 1. E-mail from a resident who opposes the proposed T-Mobile personal wireless service antenna tower. The resident's comments will be addressed by staff as part of the planning report presentation. ITEM 5. CONSENT AGENDA 06.37 Motion by Drotning, Second by Pattee to recommend to City Council approval of the May 2, 2006 Planning Commission Consent Agenda as follows: A. Approve the application of D. R. Horton, Inc. for a final plat of 78 single- family lots to be known as Fieldstone Creek 1St Addition, located at the southwest quadrant of Pilot Knob Road (CSAH 31) and Dodd Boulevard (CSAH 9). Ayes: Pattee, Manikowski, Stolte, Swecker, Detjen, Grenz, Drotning. Nays: 0 • Planning Commission Meeting May 2, 2006 Page 2 • ITEM 6. T-MOBILE Chair Swecker opened the public hearing to consider the application of T-Mobile for a Conditional Use Permit to allow the. construction of a 75 foot tall personal wireless service antenna tower on the northwest portion of the Lakeville North High School property, located at 19600 Ipava Avenue. Assistant City Attorney Poehler attested that the legal notice had been duly published in accordance with State Statutes and City Code. Chris Traiser, representing T-Mobile was in attendance at tonight's meeting to ..answer any questions .that the Planning Commission or public may have. Mr. Traiser presented an overview of the request. He indicated that a conditional use permit for the same tower at the same location was approved in 2004 but was not constructed for financial reasons. Planning Assistant Leif Hanson presented. the planning report. Mr. Hanson stated that T-Mobile representatives have submitted an application for a conditional use permit to` construct a 75 foot tall personal wireless. service antenna tower on the west side of the Lakeville North High School property. He indicated that on May • 24, 2004 .thee City Council approved a conditional use permit that would have allowed T-Mobile to construct the identical tower at the same location. However, the permit lapsed one year later as T-Mobile never began construction on the tower. Mr. Hanson indicated that T-Mobile has determined that the high school property is the best location for their proposed tower in order to best serve their customers in the area. Mr. Hanson displayed a photo simulation of the personal wireless service antenna .tower, which was taken from the west side of Ipava Avenue looking east, showing how the tower would be seen from the single family neighborhood located to the southwest of the tower. Mr. Hanson stated .that the proposed color of the tower is brown, which will blend in with the adjacent trees and landscaping. Mr. Hanson indicated that in order to accornrnodate the construction of the tower, a 30 foot tall light pole located along the driveway on the north side of the school's property will .need to be removed. He indicated that T-Mobile is proposing to attach a similar light to their proposed tower at a height of 30 feet in order to replace the light pole that would be removed. Mr. Hanson indicated that in order to keep the area level, the. construction of a 5- • foot tall retaining wall will be necessary and that a 5-foot tall chain-link safety fence will be installed on top of the retaining wall. Plann;ng Commission Meeting May 2, 2006 Page 3 Mr. Hanson stated that the proposed tower meets the performance standards of Chapter 11-30-17A2 of the Zoning Ordinance. He indicated that eleven 4-foot tall arborvitae trees will be planted around the tower and equipment to provide screening of the ground equipment. Mr. Hanson commented on the e-mail from the neighboring resident.. He explained that there was room for one other carrier on the monopole and that it would be flush mounted on the pole. Mr. Hanson also stated. that T-Mobile has assured staff that this tower would not affect television reception. Mr. Hanson stated that should. the Planning Commission recommend to the City Council approval of the conditional use permit, Planning Department staff recommends approval subject to the 7 stipulations listed in the April 25, 2006 planning report, and approval of the Findings of Fact dated May 2, 2006. Chair Swecker opened the hearing to the public for comment. There were no comments from the audience. 06.38 Motion by Pattee, Second by Drotning to close the public hearing at 6:10 p.m. Ayes: Manikowski, Stolte, Swecker, Detjen, Grenz, Drotning, Pattee. Nays: 0 Chair Swecker asked Mr. Traiser to explain how the antennas are installed on the monopole. Mr. Traiser explained that T-Mobile`s antennas are built inside the cylinder/pole. The pole starts at approximately 4 feet in diameter at the base and gets more slender toward the top of the pole. He indicated that there is one additional slot for a co-operator on the pole,. which could be flush mounted to the pole. Commissioner Drotning asked if an amendment to the conditional use permit. would be required if the design of the tower changed in the .future. Mr. Morey indicated that a conditional use permit amendment is required for any change that is considered major as defined by the Zoning Ordinance..Changes deemed minor are handled administratively. In addition, an interim. use permit is required for a tower taller than 75 feet. The Planning Commission expressed their support for the tower design proposed at this location. 06.39 Motion by Stolte, Second by Detjen to'recommend to City Council approval of the • T-Mobile Conditional Use Permit. to allow the construction of a 75 foot tall personal wireless service antenna tower on the northwest portion of the Lakeville North High School property, located at 19600 Ipava Avenue, subject to the 7 stipulations Planning Commission Meeting May 2, 2006 Page 4 • listed in the April 25, 2006 planning report and approval of the Findings of Fact dated May 2, 2006.
