HomeMy WebLinkAbout01-20-05 CITY OF LAKEVILLE Planning Commission Meeting Minutes JANUARY 20, 2005 The January 20, 2005 Planning Commission meeting was called to order by Chair Swecker in the City Hall Council Chambers at 6:00 p.m. Flag pledge and roll call of members: Present: Reuvers, Pattee, Stolte, Swecker, Detjen, Grenz, Drolning, Ex-officio Arvidson. Absent: None. Staff Present: Daryl Morey, Planning Director; Erin Seeman, Associate Planner; Jay Rubash, Assistant City Engineer; Andrea Poehler, Assistant City Attorney; and Penny Brevig, Recording Secretary. ITEM 3. APPROVAL OF MEETING MINUTES: The January 6,.2005 Planning Commission meeting minutes were approved as presented. The January 6, 2005 Planning Commission work session notes were approved as presented. • ITEM 4. ANNOUNCEMENTS: Mr. Morey indicated the following items were distributed to the Planning Commission members and staff before tonight's meeting: 1. January 19, 2005 Parks, Recreation and Natural Resources Committee Meeting Motions regarding the Crossroads 7th and 8th Addition final .plats, and the Woodhill preliminary plat. 2. Findings of Facts for conditional use .permit, rezoning, and variance. for the Woodhill preliminary plat. ITEM 5. CONSENT AGENDA 05.03 Motion by Drotning, Second by Reuvers to recommend to City Council approval of the January 20, 2005 Planning Commission Consent Agenda as follows: Approve the application of D. R. Horton for the final plat of 44 Single. Family dots to be known as Crossroads 7th Addition. Approve the application of D. R. Horton :for the final plat of 40 Row-Style . WOODHILL Chair Swecker opened the public hearing to consider the request of Town and. Country Homes for the following: A. Preliminary plat of 62 twin home units to be known as Woodhill, located west of Kenyon Avenue between 179 Street and Kerrville Trail; B. Rezoning of 18 acres of land from RH-1, High Density Residential District to RST-2, Single and Two Family Residential District; C. Variance to allow a cul-de-sac length in excess of 600 feet; D. Conditional use permit to allow a 28-foot wide local residential street within a 50-foot right-of-way. Assistant City Attorney Poehler attested that the legal notice had been duly published in accordance with State Statutes and City Code. Kevin Clark and Krista Novack from Town and Country Homes were in attendance at tonight's meeting to answer any questions that the Planning Commission or public may have. • Associate Planner Erin Seeman presented the planning report. Ms. Seeman stated that representatives of Town and Country Homes have submitted an application for the preliminary plat of Woodhill, which consists of 62 twin home units, one common area lot and three outlots, located west of Kenyon Avenue between 179 Street and Kerrville Trail. She indicated that along with the preliminary plat, the developer is requesting a conditional. use permit to allow a 28-foot wide local street within a 50-foot right-of-way, as well as a variance to allow a cul-de-sac length in excess of 600 feet. Ms. Seeman stated that Staff is requesting the rezoning of the property from RH-1, High Density Residential District, to RST-2, Single and Two Family Residential District consistent with the .proposed twin home development. A Comprehensive Plan Amendment will be :processed in conjunction with the final plat to change the eland use designation to low/medium consistent with the proposed rezoning. Ms. Seeman indicated that the Woodhill preliminary plat is proposing three outlots that include delineated wetlands and buffers and an infiltration basin, all of which will be ..deeded to the City. Ms. Seeman stated that the Woodhill preliminary plat is adjacent to Kenyon Avenue. Kindred Court and Kindred Circle will be constructed with the plat. She • indicated that the developer will widen Kenyon Avenue to a 36-foot wide urban section beginning at the existing urban section along the south plat boundary and Planning Commission Meeting January 20, 2005 Page 3 • ending at the 179 .Street intersection. Ms. Seeman stated that Kindred Court will provide the only access to the site from Kenyon Avenue. She indicated that the :developer is requesting a variance to allow a cul-de-sac length in excess of 600 feet. Ms. Seeman stated that a complete tree inventory and preservation plan has been submitted by the developer. She indicated that 32% of the significant trees are proposed to be saved with another 4% identified as custom save. Ms. Seeman indicated that staff and the Parks, Recreation and Natural Resources Committee are recommending a cash contribution to satisfy the park dedication requirements. She stated that the developer is required to construct an 8-foot bituminous trailway along the west side Kenyon Avenue, beginning at the south plat boundary and ending at the 179 Street intersection. The Parks, Recreation and Natural Resources Committee made a recommendation for approval at their January 19, 2005 meeting, which was distributed to the Planning Commission at tonight's meeting. Ms. Seeman summarized the RST-2 District performance standards. The developer is proposing to construct three different styles for the 31 twin home buildings. Ms. • Seeman stated that all of the proposed twin home building lot widths and setback requirements meet the minimum Zoning Ordinance requirements. She indicated that the homeowners association must be responsible for all exterior building maintenance, approval of any exterior architectural modifications, landscaping, snow clearing, and regular maintenance of private drives and common areas. Homeowner's association documents have been submitted by the developer. Ms. Seeman indicated that according to the Zoning Ordinance all twin home dwelling units must have an attached garage at least 440 square feet in area and 20 feet in width for units with basements. She stated that the proposed twin home. styles do not meet. the minimum ;garage floor area requirement. The building floor plans must be revised prior to City Council consideration of the final plat. 1VIs. Seeman stated that a preliminary landscape plan has been submitted by the developer. She indicated that landscape screening would be provided as a buffer along Kenyon Avenue and the development to the north. Ms. Seeman stated that should the Planning Commission recommend to the City Council approval. of the preliminary plat, rezoning, variance, and conditional use permit, Planning Department staff recommends approval subject to the 10 stipulations listed in the January 14,.2005 planning report, and approval of the . Findings of Fact dated January 20, 2005. Planning Commission Meeting January 20, 2005 Page 4 • Chair Swecker opened the hearing to the public for comment. There were no comments from the audience. 05.04. Motion by Pattee, Second by Reuvers to close the public hearing at 6:10 p.m. Ayes: Pattee, Stolte, Swecker, Detjen, Grenz, Drotning, Reuvers. Nays: 0 Commissioner Grenz had questions regarding the street width, cul-de-sac radius and street grades. Assistant City Engineer Jay Rubash explained that the developer requested a conditional use permit to allow a 28-foot wide local street within a 50- foot right-of-way because it is in an environmentally sensitive area. He stated that the radius of the two cul-de-sacs is standard and is in compliance with the Zoning. Ordinance requirements. Mr. Rubash indicated that the maximum grade of the street is S%, which meets Subdivision Ordinance requirements. Commissioner Drotning stated that the need for a variance for excess cul-de-sac length was determined when the Prairie Lake development was approved because a street connection between the two sites was not provided due to the apartment development proposed for the subject property at that time. He also indicated that the rezoning to a lower density zoning fits well with the existing uses in the surrounding area. Ms. Seeman indicated that per the Parks, Recreation and Natural Resources Committee recommendation, the developer has agreed to work with the City's Environmental Resources Coordinator, Mac Lafferty, to develop a management plan for protecting the remaining trees and removing exotic species from the property. The developer indicated that Town and Country Homes wants to be proactive regarding #ree preservation. Mr. Morey commented that there was a neighborhood meeting on October 25, 2004, which the developer and staff attended. He indicated that the concerns of the neighbors were addressed at that meeting. Commissioner'Grenz thought that a sidewalk would be appropriate along Kindred Court. He also wanted no parking posted on one side of the street. Mr. Morey indicated that sidewalks are not typically installed on cul-de-sac streets, and he ,stated that Parks and Recreation Director Steve Michaud did not feel a sidewalk was necessary in this instance. • Planning Commission Meeting January 20, 2005 Page 5 Mr. Morey stated that the installation of "no parking" signs on one side of the street will be handled by a resolution approved by the City Council with the final plat. He indicated that the "no parking" stipulation is in the January 14, 2005 Engineering report, but suggested a Stipulation 11 be added to the Planning Commission motions, stating: 11. Parking shall be limited to one side of both cul-de-sac streets. Mr. Clark thanked the Planning Commission and staff and looks forward to working with the City of Lakeville on this development. 05.05 Motion by Stolte, Second by Pattee to recommend to City Council approval of the .preliminary plat of 62 twin home units to be known as Woodhill, located west of Kenyon Avenue between 179 Street and Kerrville Trail; rezoning of 18 acres of land :from RH-1, High Density Residential District to RST-2, Single and Two Family Residential District; a variance to allow a cul-de-sac length. in excess of 600 feet; and a conditional use permit to allow a 28-foot wide local residential street within a 50- foot right-of-way, subject to the 10 stipulations listed in the January 14, 2005 planning report, along with the addition of Stipulation 11, and approval of the Findings of Facts dated January 20, 2005. Ayes: Stolte, Swecker, Detjen, Grenz, Drotning, Reuvers, Pattee. Nays: 0 ITEM 7. NEW BUSINESS Mr. Morey reminded the Planning Commission that the next Planning Commission meeting will be February 3, 2005 and that there will be a short work session after the meeting.
