RESOLUTION VACATING PERMANENT EASEMENTS
WHEREAS, the Planning Commission has conducted a public hearing, preceded by
two (2) weeks published notice, to consider the following described easement vacation,
and
WHEREAS, the City Council has determined that it is in the public interest to
approve the easement vacation.
NOW, THEREFORE, BE IT RESOLVED by the Lakeville City Council:
1. The following permanent easements situated in Dakota County, Minnesota and
legally described as follows are hereby vacated:
Document No. 302540 (drainage, utility, and right-of-way)
Document No. 305248 (drainage and utility)
Document No. 807674 (drainage and utility)
Document No. 829374 (bike and pedestrian path)
Document No. 1270544 (roadway, drainage, and utility)
The above-mentioned permanent easements are located on property legally
described on the attached Exhibit A.
2. The City Clerk is directed to file a certified copy of this resolution with the Dakota
County Recorder.

• That part of the East one half of the Southwest quarter (E %2 of SW '/4) of Section Twenty-nine (29),
Township One Hundred Fourteen (114}, Range Twenty (20), lying South of Chicago, Milwaukee and St.
Paul Railroad right-of--way, Dakota County, Minnesota except that part thereof described as follows:
That part of the East half of the Southwest quarter (E %i of SW '/4) of Section Twenty-nine (29),
Township One Hundred Fourteen (114), Range Twenty (20), lying South of Chicago, Milwaukee
and St. Paul Railroad right-of--way, Dakota County, Minnesota described as follows:
Commencing at the Northwest corner of the Southeast quarter of the Southwest quarter (SE of
SW'/o) of Section Twenty-nine (29), Township One Hundred Fourteen (114), Range Twenty
(20), thence South along said West line of the Southeast quarter of the Southwest quarter (SE '/4
of SW '/4) a distance of 135 feet, thence East 267 feet, thence North parallel with the West line of
said East half of the Southwest quarter (E'/z of SW '/4) to the South line of said Railroad
right-of-way, thence Northwesterly along said Railroad right-of--way to the West line of the East
half of the Southwest quarter (E 'h of SW '/4) of said Section Twenty-Nine (29), thence South
along said West line to the point of beginning. ALSO EXCEPT the East 363.35 feet of the South
350.00 feet of the Southeast quarter of the Southwest quarter (SE'/4 of SW'/4 all in Section
Twenty-Nine (29), Township One Hundred Fourteen North (114N), Range Twenty West (20W).

That part of the W '/z of the SW '/4 of the SE '/4 of Section 29, Township 114, Range 20, Dakota County,
Minnesota, lying southerly of the abandoned Chicago, Milwaukee, St. Paul and Pacific Railroad
right-of--way; lying southwesterly of the southwesterly right-of--way line of the Soo Line Railroad; and
lying west of a line 200 feet west of the west line of the plat of FAIRFIELD, according to the recorded
plat thereof.
Excepting therefrom the west 10 feet of the south 350 feet thereof.
Also excepting therefrom that part described as follows:
Commencing at the southwest corner of the SE'/4 of said Section 29; thence East, assumed
bearing, on the south line of said SE '/4 a distance of 331.00 feet to the actual point of beginning;
thence North 00 degrees 39 minutes 55 seconds West a distance of 233.00 feet; thence East a
distance of 100.00 feet to a point on a line 200 feet west of the west line of the plat of
FAIRFIELD, according to the recorded plat thereof; thence South 00 degrees 39 minutes 55
seconds East on said line 200 feet west of the west line of said plat of FAIRFIELD a distance of

the East half of the Southwest Quarter and the West half of the Southeast Quarter of Section 29,
Township 114, Range 20, Dakota County, Minnesota, lying southerly of the centerline of said railroad as
shown in Dakota County Recorder Document No. 570089 and lying east of the west 267.00 feet of said
East half of the Southwest Quarter and lying westerly of a line 50 feet westerly of and parallel with the
centerline of the former Minneapolis, Northfield and Southern. Railway.
