RESOLUTION CONCERNING THE EXTENSION OF
RETAIL TOBACCO SALES LICENSES
WHEREAS, the City of Lakeville currently exercises licensing and regulating
authority over retail tobacco sales under Minn. Stat. 461.12, and
WHEREAS, under Minn. Stat. 461.12, the county board for Dakota County is
required to license and regulate the sale of tobacco in any city that does not license and
regulate retail tobacco sales, and
• WHEREAS, the City desires to discontinue its licensing and regulation of retail
tobacco sales as soon as Dakota County is prepared to license and regulate retail tobacco
sales in the City of Lakeville, and
WHEREAS, licenses for the retail sale of tobacco within the City of Lakeville
shall expire effective December 31, 1998, and
WHEREAS, Dakota County has indicated that it will not be prepared to license
and regulate retail tobacco sales in the City until some time after February 1, 1999, and
WHEREAS, to allow sufficient time for Dakota County to prepare for licensing
and regulation of retail tobacco sales in the City and to avoid renewing all expiring
licenses for only a portion of the year, effective and efficient government is promoted by
extending all retail tobacco sale licenses valid on December 31, 1998 to the date Dakota
County issues new tobacco licenses.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Lakeville:
All licenses for the retail sale of tobacco valid on December 31, 1998 are
hereby extended until Dakota County issues a license for the retail sale of
tobacco to the licensee, but in no event shall licenses be extended past July
• 1, 1999.
ADOPTED this 15~" day of March 1999 by the City Council of the City of
Lakeville.
