Planning Commission Meeting Minutes
• JULY 21, 2005
The July 21, 2005 Planning Commission meeting was called to order by Chair
Swecker in the City Hall Council Chambers at 6:00 p.m.
Flag pledge and roll call of members:
Present: Pattee, Stolte, Swecker, Detjen, Grenz, Reuvers, Ex-officio Arvidson.
Absent: Drotning.
Staff Present: Daryl Morey, Planning Director; Leif .Hanson, Zoning
Enforcement/ Recycling Coordinator; Jay Rubash, Assistant City Engineer; Andrea
Poehler, Assistant City Attorney; and Penny Brevig, Recording Secretary:
ITEM 3. APPROVAL OF MEETING MINUTES:
The June 16, 2005 Planning Commission meeting minutes were approved as
presented.
ITEM 4. ANNOUNCEMENTS:
Mr. Morey indicated the following items were distributed to the Planning
Commission members and staff before tonight's meeting.
1. July 20, 2005 Parks, Recreation and Natural Resources Committee
meeting motions regarding the Chadwick Farm 3rd Addition final
plat, the Prairie Lake 6d~ Addition final plat, and the Prairie Lake 7th
Addition final plat.
2. A handout from the Dakota County Transportation Department
regarding an open house on July 26, 2005 to discuss the East West
Corridor Preservation Study Phase IL
In response to Chair Swecker's question, Mr. Morey stated. that the East West
Corridor Preservation Study handout was provided for informational purposes and
Planning Commission members can attend the open house if they would like to
learn more about the study. He stated that City staff are involved in the Study, will
attend the open house, and will keep the Planning Commission informed of the
process.
ITEM 5. CONSENT AGENDA
05.69 Motion by Pattee, Second by Stolte to recommend to City Council approval of the
July 21, 2005 Planning Commission Consent Agenda as follows:

A. Approve the application of D. R. Horton for the final plat of 35 single
family lots to be known as Chadwick Farm 3rd Addition, located south of
210th Street, north of 215th Street (C. R. 70) and east of Jacquard Avenue.
B. Approve the application of US Home Corporation for the final plat of 24
townhome units to be known as Prairie Lake 6th Addition, located north
of 185th Street (C. R. 60) and west of I-35.
C. Approve the application of US Home Corporation for the final plat of 16
townhome units to be known as Prairie Lake 7th Addition, located north
of 185th Street (C. R. 60) and west of I-35.
Ayes: Pattee, Stolte, Swecker, Detjen, Grenz, Reuvers.
Nays: 0
ITEM 6. GANDER MOUNTAIN
Chair Swecker opened the public hearing to consider the application of Gander
Mountain for a Conditional Use Permit to allow outdoor sales and display, located
at 16861 Kenyon Avenue. Assistant City Attorney Poehler attested that the legal
notice had been duly published in accordance with State Statutes and City Code.
• Marcella Murphy, Store Development Manager for Gander Mountain, was in
attendance at tonight's meeting to answer any questions that the Planning
Commission or public may have. Ms. Murphy presented an overview of the
project.
Zoning Enforcement/ Recycling Coordinator Leif Hanson presented the planning
report. Mr. Hanson stated that Gander Mountain has submitted an application for
a conditional use permit to store and display sales merchandise outside on their
property.
Mr. Hanson stated that Gander. Mountain currently stores and displays trailers,
AT'V's, canoes, kayaks, and motorboats outside on the property. He indicated .that
Gander Mountains conditional use permit application is a result of City staff
working with Gander Mountain to bring their property into compliance with the
requirements for outdoor sales and display on commercial properties.
Mr. Hanson reviewed the four criteria for outdoor service, sale and rental in the C-3
Zoning District as it relates to Gander Mountains conditional use permit
application, including location, screening, and parking.

Mr. Hanson indicated that there is a pedestrian ramp located on the northeast
corner of the Gander Mountain building, where staff is recommending that no
merchandise be displayed. Mr. Hanson stated that staff is recommending
Stipulation 1 be amended to read: "All items displayed and stored outside must be
located on the property according to the approved site plan, except for the
pedestrian ramp on the northeast corner of the building. "
Mr. Hanson stated that should the Planning Commission recommend to the City
Council approval of the Gander Mountain CUP, Planning Department staff
recommends approval subject to the 3 stipulations listed in the July 13, 2005
planning report, as amended, and approval of the Findings of Fact dated July 21,
2005.
Chair Swecker opened the hearing to the public for comment.
There were no comments from the audience.
05.70 Motion by Detjen, Second by Reuvers to close the public hearing at 6:11 p.m.
Ayes: Stolte, Swecker, Detjen, Grenz, Reuvers, Pattee.

Commissioner Grenz clarified with Ms. Murphy that there was a handicapped
accessible ramp in front of the store at the main entrance.
Commissioner Pattee suggested the following amendment to Stipulation 1 to read
as follows:
1. All items displayed and stored outside must be located on the
.property according to the approved site plan, except for the
pedestrian ramp located on the northeast corner of the building upon
which there shall be no merchandise displayed.
The Planning Commission agreed with this amendment.
Commissioner Reuvers referred to the e-mail from a Lakeville resident opposed to
the outside storage at Gander Mountain. Mr. Reuvers indicated that the Zoning
Ordinance does allow for outside storage by conditional use permit subject to
compliance with certain standards.
Chair Swecker requested clarification of the deferred parking spaces, including the
• original parking deferment and the proposed additional spaces to be deferred.

Mr. Hanson indicated that the original deferred spaces are located in the parking
area north of the building and are striped for RV's and vehicles with trailers. The
proposed deferred parking spaces are located on the north side of the building and
are proposed to be utilized for outdoor storage. Mr. Morey indicated that if, in the
future, parking demand exceeds supply, the oversized parking spaces would be re-
striped as normal size parking spaces and the outdoor storage on the parking
spaces on the north side of the building would have to be removed.
05.71 Motion by Stolte, Second by Pattee to recommend to City Council approval of the
Gander Mountain Conditional Use Permit to allow outdoor sales and .display,
located at 16861 Kenyon Avenue, subject to the 3 stipulations listed in the July 13,
2005 planning report, as amended, and approval of the Findings of Fact dated July
21, 2005.
Ayes: Swecker, Detjen, Grenz, Reuvers, Pattee, Stolte.

Planning Commission Work Session

Marion Conference Room
The Planning Commission work session commenced at 6:30 pm in the Marion
Conference Room at City Hall.
Planning. Commissioners Present: Kerrin Swecker, Lowell Miller Stolte, Steve Pattee,
Paul Reuvers, Gerry Grenz, Dale Detjen and ex-officio John Arvidson.
Staff Present: Planning Director Daryl Morey and Associate Planner Frank Dempsey
and Assistant City Engineer Jay Rubash.
Also Present: Steve and Cheri Schroeder, Brian Nowak Architect.
Frank Dempsey presented an overview of the proposed project, variance and the hardship
that the owners of property at 17155 Kirben Avenue are presenting for the construction of a
new house on the property. The property is located within the Shoreland Overlay District of
Lake Marion. The existing house was constructed in 1940 and has not been occupied since
2001 due to the existing failing septic system and bats in the house. The proposed plans call
for removing the existing non-conforming house, two non-conforming accessory buildings and
the removal of the non-conforming septic system. The plans include a proposal to build a new
house setback 75 feet from the OHWL of Orchard Lake and a new septic system and drain-
field that would meet the 100-foot setback to the OHWL. Due to the topography of the
property and the location of the 100-foot setback boundary through the property, there are no
other reasonable options that would allow the construction of a new house on the lot prior to
City sanitary sewer service to the property. Once City sanitary sewer is brought to the
property, the house will meet the required 75-foot setback to the OHWL. City staff and the
Schroeder's failed to gain a consensus from the_property owners along Kirben Avenue for a
City improvement project that would bring City sanitary sewer, water, and a paved street to
this neighborhood.
The Planning Commission agreed that there is a justifiable hardship associated with the
variance request and the elimination of the non-conformities meets Zoning Ordinance
requirements.
