RESOLUTION VACATING PONDING AND DRAINAGE EASEMENTS IN
THE PROPOSED PLAT OF MARION FIELDS SECOND ADDITION

two (2) weeks published notice, to consider the following described ponding and
drainage easement vacation, and
WHEREAS, the City Council has determined that it is in the public interest to
approve the ponding and drainage easement vacation.
NOW, THEREFORE, BE IT RESOLVED by the Lakeville City Council:
1. The following ponding and drainage easements are hereby vacated:
The permanent public ponding and drainage easements recorded as Document Numbers
199265 and 828806 and located within the following described property:
All that part of the abandoned right-of-way of the Chicago, Milwaukee, St. Paul, and
Pacific Railroad in the Southwest Quarter of Section 29, Township 114, Range 20, lying
Southerly of the centerline of said Railroad as shown in Dakota County Recorder's
Document No. 570089, except that part thereof lying between the West line of the East
half of the Southwest Quarter and the East line of the West 267 feet of said East half of
the Southwest Quarter, which lies within the following described perpetual easement for
ponding and drainage:
The West 400.00 feet of that part of the abandoned right-of-way of the Chicago,
Milwaukee, St. Paul, and Pacific Railroad in the Southwest Quarter of Section 29,
Township 114, Range 20, lying Southerly of the centerline of said Railroad as

shown in Dakota County Recorder's Document No. 570089, said 400.00 feet.
being measured at right angles to the West line of said Southwest Quarter of
Section 29.
AND
That part of the West half of the Southwest Quarter of Section 29, Township 114, Range
20, lying and being South of the Hastings and Dakota Railroad right-of-way, except the
North 120 feet of the South 573 feet of the East 233 feet of the Southwest Quarter of the
Southwest Quarter, which lies within the following described perpetual easement for
ponding and drainage:
The West 400.00 feet of that part of the Northwest Quarter of the Southwest
Quarter of Section 29, Township 114, Range 20, Dakota County, Minnesota, lying
Southerly of the Chicago, Milwaukee, and St. Paul Railroad Company
right-of-way (now vacated).
AND
A strip of land 60.00 feet wide extending from the Easterly and Southerly lines of the
above described 400.00 foot wide easement to the East line of the Southwest Quarter of
the Southwest Quarter of said Section 29, the Southwesterly line of said 60.00 foot wide
strip of land being described as follows: Beginning at the Southeasterly corner of the
above described West 400.00 feet of the Northwest Quarter of the Southwest Quarter,
thence running Southeasterly in a straight line to a point in the Easterly line of the
Southwest Quarter of the Southwest Quarter of said Section 29 distant 765.00 feet
Northerly of the Southeasterly corner thereof, said 60.00 foot wide strip subject to the
rights of the public in Dodd Boulevard.
2. The City Clerk is directed to file a certified copy of this resolution with the Dakota
County Recorder.
