HomeMy WebLinkAbout99-185 CITY OF LAKEVII,LE DAKOTA COUNTY, l~BNNESOTA RESOLUTION Date August 16, 1999 Resolution 99-185 Motion By Mulvihill Seconded By Luick RESOLUTION APPROVING ACCESS TO LOTS 12 AND 13, BLOCK 2, JACKSON'S FIRST ADDITION, DAKOTA COUNTY, NIINNESOTA Recitals WHEREAS, Bruce and Diane Hansen are the owners of Lots 12 and 13, Block 2, Jackson's First Addition, Dakota County, Minnesota (hereinafter "Hansen Lots"); and WI~REAS, as part of the County Road 46 project (C.P. 46-05) Dakota County acquired by condemnation a small sliver of the Hansen parcels for additional right of way to construct Kenrick Avenue on a portion of the previously platted 164` Street right of way; and V'VHEREAS, on June 9, 1999, the Court-appointed condemnation commissioners issued their report in the form of an alternative award. of compensation to the Hansens for the land taken. Alternative No. 1 awarded compensation in the amount of $41,500.00 conditioned upon the City of Lakeville passing a resolution within ninety (90) days of the award approving one full-directional retail commercial access of at least thirty-two (32) feet in width to and from Kenrick Avenue for the future development of Lots 12 and 13, Block 2, Jackson's First Addition; and WHEREAS, both the County and the property owners are appealing the amount of the condemnation award to District Court; and VVIlEREAS, each of the Hansen Lots (Lots 12 and 13) abutting the previous 164 Street right of way and current Kenrick Avenue was and remains entitled to access to the adjoining public street if developed separately; and WHEREAS, this resolution is adopted to comply with the condemnation commissioners' request for approval of joint access to the Hansen Lots. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lakeville: • 1 80329 1. One full-directional retail commercial access of at least thirty-two (32) feet in width to and from Kenrick Avenue to serve as an approved driveway ingress and egress to and from the future development of Lots 12 and 13, Block 2, Jackson's First Addition ("Hansen Lots") is hereby approved. 2. Development of the lots must comply with the City's official controls and other applicable development standards in place at the time of development.
