RESOLUTION VACATING UTILITY AND TRAIL EASEMENTS
AND STREET RIGHT-OF-WAY
•
WHEREAS, the Planning Commission has conducted a public hearing, preceded by
two (2) weeks published notice, to consider the following described utility and trail
easement and street right-of-way vacation, and
WHEREAS, the City Council has determined that it is in the public interest to
approve the utility and trail easement and street right-of-way vacation.
NOW, THEREFORE, BE IT RESOLVED by the Lakeville City Council:
1. The following utility and trail easements and street right-of-way situated in
Dakota County, Minnesota and .legally described as follows are hereby vacated:
(see Exhibit A)
2. The City Clerk is directed to file a certified copy of this resolution with the Dakota
County Recorder.
APPROVED AND ADOPTED this 6th day of July, 1999.

Exhibit A

That part of Kensington Boulevard as platted and dedicated in LAKEVIEW ESTATES,
according to the recorded plat thereof; Dakota County, Minnesota lying southerly of the westerly
extension of the northerly line of Outlot F, said LAKEVIEW ESTATES.
AND
A permanent easement for public trail and walkway purposes over, under and across the
northerly 5.00 feet of the- following described parcel:
That part of the abandoned right of way of the Chicago, Milwaukee, St. Paul & Pacific
Railroad lying west of the east line of the Southwest Quarter of the Northeast Quarter
of Section 25, Township 114, Range 21, Dakota County, Minnesota, and lying east of
Old State Highway No. 65, now known as Kenrick Avenue, EXCEPT the north 27.00
feet of said abandoned right of way and also EXCEPT that part platted as LAKEVIEW
ESTATES.

All that part of the Southeast Quarter of the Northwest Quarter and the South Half of
the Northeast Quarter and the Northeast Quarter of the Southwest Quarter of Section
25, Township 114, Range 21, AND
• All that part of the abandoned right of way of the Chicago, Milwaukee, St. Paul &
Pacific Railroad Company in Section 25, Township 114, Range 21, as set forth in
Dakota County Recorder's Document No. 570089, lying southerly of the northerly right
of way line and lying westerly of the east line of the Southwest Quarter of the Northeast
Quarter and easterly of Highway No. 65.
Which lies within the following described perpetual easement for public utility purposes:
A strip of land 60.00 feet in width, the northerly line of which is contiguous with the
centerline of County State Aid Highway No. 64 .(205th Street West, formerly Shakopee
Road). Said Strip of land is to extend from the easterly right of way line of State Trunk
Highway No. 65 to the east line of the Southwest Quarter of the Northeast Quarter of
Section 25, Township 114, Range 21, Dakota County, Minnesota.
Except that part of which lies within any perpetual easement of record.
