RESOLUTION DISPENSING WITH STATUTORY
REQUIREMENTS FOR REVIEW BY PLANNING COMMISSION
OF DISPOSAL AND ACQUISITION OF PROPERTY
WHEREAS, the City is proposing to dispose of City property ("City Property")
legally described in the attached Exhibit "A, " under the terms of the proposed purchase
agreement between James E. Ondov and Nancy J. Ondov ("Buyers") and the City of
Lakeville Purchase Agreement"), attached hereto and incorporated herein as Exhibit
°'B,'° and;
• WHEREAS, the terms of the Purchase Agreement between the City and Buyers
require the City to acquire the Buyers' property ("Buyers' Property") described in the
attached Exhibit "C" by quit claim deed and to reconvey to Buyers the Buyers' Property
by quit claim deed, and;
WHEREAS, Minn. Stat. § 462.356, subd. 2 requires that the Planning
Commission review the City's proposed acquisitions and dispositions of property, and;
WHEREAS, Minn. Stat. § 462.356, subd. 2 provides for an exception from the
Planning Commission review requirement upon 2/3 vote of the City Council dispensing
with the requirement and finding that the acquisition or disposal of the property has no
relationship to the comprehensive municipal plan.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Lakeville:
1. The City Council finds that the acquisition and disposition of the City Property
and Buyers' Property under the Purchase Agreement has no relationship to the
comprehensive municipal plan.
• 2. Review by the Planning Commission of the acquisition and disposal of the City
Property and Buyers' Property is hereby dispensed with, the proposed transaction is
hereby approved, and the Mayor and City Clerk are authorized and directed to execute
all documents, and take all appropriate measures to convey and dispose of the City
i Property and Buyers' Property under the terms of the Purchase Agreement.
ADOPTED this 6th day of July , 1999, by a 2/3 vote of the City
Council of the City of Lakeville.

Legal Description of City Property
That part of Outlot D lying easterly of the east line of Lot 9, Block 2, and its
northerly extension, and lying southwesterly of a line described as follows:
Commencing at the northwest corner of Lot 1, Block 7; thence South 88
degrees 28 minutes 48 seconds East, assumed. bearing, along the north line
of said Lot 1 a distance of 22.49 feet to the beginning of the line to be
described; thence North 50 degrees 25 minutes 25 seconds West a distance
of 58.98 feet to the said northerly extension of the east line of Lot 9, Block 2,
and said line there terminating. All in MARION VILLAGE SECOND
ADDITION, Dakota County, Minnesota, according to the recorded plat
thereof.
