RESOLUTION ADOPTING ASSESSMENTS FOR
IMPROVEMENT PROJECT 91-3
RECONSTRUCTION OF CR 46/CSAH 5/I-35 INTERCHANGE
IMPROVEMENTS
WHEREAS, pursuant to proper notice duly given as required by law, the Council has
met, heard and passed upon all objections to the proposed assessment for Reconstruction of CR
46/CSAH 5/I-35 Interchange, Improvement Project 91-3.
NOW, THEREFORE, BE IT RESOLVED by the City Council of Lakeville,
Minnesota:
1. Such proposed assessments No. 945 in the amount of $ 717,776.15, and No. 946 in
the amount of $53,821.67, copies of which are attached hereto and made a part hereof, are
hereby adopted and shall constitute the special assessment against the lands named therein, and
each tract of land therein included is hereby found to be benefited by the proposed
improvement in the amount of the assessment levied against it.
2. Such assessment No. 945 shall be considered payable in equal annual installments
over a period of twenty (20) years, the first of the installments to be .payable on or before the
first Monday in January 1999, and shall bear interest at the rate of 8.00 percent per annum
from the date of the adoption of this assessment resolution. To the first installment shall be
added interest on the entire assessment from the date of this resolution until December 31,
1999. To each subsequent installment when due shall be added interest for one year on all
unpaid installments.
3. Such assessment No. 946 shall be considered deferred with interest, until such time
as: parcel number 22-00210-010-01 is subdivided; parcel number 22-30750-010-01 is either
subdivided or access is provided to Kenrick Avenue; parcel numbers 22-00110-013-29, 22-
00110-010-32 and 22-00110-020-32 until sanitary sewer is available. At such time, the
• deferment shall automatically be terminated. When the deferment ends the accumulated.
interest shall be added to the principal and the payments shall be divided into a number of

installments such that the last installment thereof will be payable not less than twenty (20)
years but not more than thirty (30) years after the levy of the assessment. The assessment
shall beaz interest at the rate of 8.0 percent per annum. To each subsequent installment when
due shall be added interest for one year on all unpaid installments. If, however, the deferment
has not ended prior to November 16, 2028, the entire assessment will be considered abated in
accordance with Minnesota Statutes 429.
4. The owner of any property so .assessed may, at any time prior to certification of the
assessment to the County Auditor, pay the whole of the assessment on such property, with
interest accrued to the date of payment, to the City Treasurer, except that no interest shall be
charged if the entire assessment is paid within thirty (30) days from the adoption of this
resolution; and he or she may,. at any time prior to November 15th of any yeaz, pay to the City
Treasurer the entire amount of the assessment remaining unpaid, with interest accrued to
December 31 of the yeaz in which such payment is made
5. The City Clerk shall forthwith transmit a certified duplicate of this assessment to the
County Auditor to be extended on the proper tax lists of the county, and such assessments shall
be collected and paid over in the same manner as other municipal taxes.
ADOPTED by the City Council of the City of Lakeville, Minnesota, on the 16th day
of November, 1998.
