RESOLUTION APPROVING APPLICATION FOR CONVEYANCE OF TAX-
FORFEITED LAND, RECORDING OF EASEMENTS AND SALE OF CERTAIN
TAX FORFEIT PARCELS SUBJECT TO COMBINATION OF SALE
WHEREAS, there are six tax forfeited parcels within the City of Lakeville which
are deemed to be of best use in public ownership for public benefit as authorized by
Minnesota Statute 282.01; and
WHEREAS, there are eight tax forfeited parcels which are deemed to be of
highest and best use in private ownership when combined with a contiguous parcel; and
WHEREAS, adequate and appropriate easements for. drainage streets, roads and
utilities should be recorded against tax forfeited parcels prior to their sale as authorized by
Minnesota Statute 282.04, Subd. 4 in order to achieve maximum economic public benefit
for the common good of the community.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of
Lakeville that the City Clerk is directed to submit to the Dakota County Auditor/Treasurer
the Application By A Government Subdivision For Conveyance Of Tax Forfeited Land for
the following parcels:
a) 22-13301-OYO-00, Bassetts Second Addition, Outlot A for drainage and storm
water purposes.
b) 22-13302-080-01 Bassetts Third Addition Lot 8, Block 1 for the purpose of
drainage, conserving natural resources or future recreation.
c) 22-19900-180-OS Deer Park Addition to South St Paul, Lots 11-18, Block 5 for
the purpose of conserving natural resources or providing recreation.
d) 22-21175-040-00 Donnay's Valley Park 6~' Addition, Outlot D for road
accessibility purposes.
e) 22-67500-010-00 Shady Oak Shores, Outlot A for drainage purposes.
• f) 22-46901-110-00 Lyndale Lake Club #2
• BE IT FURTHER RESOLVED that the special assessments on Parcels 22-
13301-010-00 and 22-13302-080-01 are hereby abated.
BE IT FURTHER RESOLVED that the City Council of the City of Lakeville
hereby encourages the Dakota County Board of Commissioners to require as a condition of
sale that the parcels be combined with a contiguous parcel as authorized by Minnesota
Statute 282.01 Subd. 7a:

BE IT FURTHER RESOLVED that a drainage easement as described on Exhibit
A attached hereto be hereby recorded on Parcel 22-27500-171-02 (legally described as:
part of Lot 17, Block 2, lying NE of line commencing NW corner SE to S line lot 17 said
part being 1VE corner of Lot 16, Forest Hills Addition) prior to tax forfeit sale of said
• parcel as authorized by Minnesota Statute. 282.04, Subd. 4.
BE IT FURTHER RESOLVED that .the special assessments on Parcel 22-
27500-171-Q2 part of Lot 17, Block 2, Forest Hills Addition and Parcel. 22-21172-120-OS
Donnays Valley Park 6`i' Addition Outlot D are hereby abated if and when the parcel(s) are
combined with an adjoining parcel.
BE IT FURTHER RESOLVED that the City Council hereby requests permission
from the Dakota County Auditor/Treasurer and the Dakota County Board of
Commissioners to remove a storm sewer pipe from Parcel 22-27500-071-OZ part of Lot
17, Block 2, Forest Hills Addition as authorized by Minnesota Statute 282.04, Subd. 2.
BE IT FURTHER RESOLVED that the cost of storm sewer pipe removal from
Parce122-27500-071-02 part of Lot 17, Block 2, Forest Hills Addition shall be disbursed
from tax forfeit proceeds as authorized by Minnesota Statute 282.09, Subd. 1.
BE IT FURTHER RESOLVED that the County Auditor/Treasurer. is hereby
requested to record easements for construction of County Road 70 against Parcel 22-
47900-024-01 part of Lot 2, Block 2, McStop Addition prior to tax forfeit sale of said
parcel as authorized by Minnesota Statute 282.04, Subd. 4.

Minnesota, this 8th day of September, 1998.

DRAINAGE & UTILITY EASEMENT
Legal Description
A permanent easement for drainage and utility purposes over, under and across
the East 20 feet of Lot 17, Block 2, Forest Hills, according to the plat on file in the
office of the county recorder, Dakota County, Minnesota.
