HomeMy WebLinkAbout98-033 p CITY OF LAKEVILLE DAKOTA COUNTY, MINNESOTA RESOLUTION Date: March 2, 1998 Resolution No. 98-33 Motion By: Holberg Seconded By: Mulvihill A RESOLUTION ADMONISHING THE METROPOLITAN COUNCIL AND THE MUNICIPAL ENTITIES PARTICII'ATING IN THE CSAH 42 CORRIDOR STUDY NOT TO CONSIDER, RECOMMEND OR ADOPT ANY ALTERNATIVE MITIGATING MEASURE THAT AFFECTS, EFFECTS OR OTHERWISE IMPACTS MURPHY-HANREHAN PARK RESERVE WHEREAS, the 1964 Metropolitan Transportation Plan of the Metropolitan Planning Commission Joint Program, the 1973 Metropolitan Council Plan and all subsequent Metropolitan Council Transportation Plans have recognized a need for, and recommended, at least one east-west arterial of major importance south of I-494 in Northern Dakota and Scott Counties; and WHEREAS, the Metropolitan Transportation Policy Plan of the Metropolitan Council, the Scott • County Transportation Plan and the Dakota County Board-approved Functional Classification Map each designate CSAH 42 as a principle arterial, along with TH 13 and CSAH 32; and WHEREAS, County State Aid Highway 42 has been designated by Dakota County as a Principle Arterial Roadway since 1986; and WHEREAS, the Metropolitan Council identifies seventeen (17) criteria for non-freeway principle arterials; and WHEREAS, CSAH 42 currently meets or exceeds eight (8) criteria, does not meet five (5) criteria and two (2) criteria are not applicable; and WHEREAS, Dakota County and the cities adjacent to CSAH 42 have implemented the CSAH 42 Corridor Study to examine the role and function of CSAH 42 as a principle arterial through Dakota and Scott Counties and to analyze potential alternatives to CSAH 42 which meet or more closely approximate the Metropolitan Council's criteria for principle arterial; and WHEREAS, despite the apparent need for compliance with the criteria regarding Functional Classifications, the Metropolitan Council views its criteria for principle arterial as only guidelines and that the failure to meet or exceed all of the criteria is not a reason to change the Functional Classification of a particular roadway; and • WHEREAS, CSAH 42 is one of only six (6) principle arterial highways under local jurisdiction in the seven county metropolitan area; all other principle arterials are under state jurisdiction; and WHEREAS, there are certain economic advantages to Dakota County classifying CSAH 42 as a principle arterial; and • WHEREAS, classified as a principle arterial, CSAH 42 is eligible for federal funding as part of the National Highway System and that if CSAH 42 were classified as a minor arterial, National Highway System funding potentially may be lost; and WHEREAS, some participants in the CSAH 42 Corridor Study have suggested considering enhancements to and the expansion of CR 46 westerly to CR 74 as a means to alleviate congestion on CSAH 42 and facilitate east-west traffic through northern Dakota and Scott Counties; and WHEREAS, the Metropolitan Council's Transportation Development Guidance/Policy Plan and its Regional Recreation Open Space Development Guidance/ Policy Plan appear to embody conflicting policies with respect to two (2) of the four (4) Regional System Plans; and WHEREAS, the credibility, intergrity and viability of the Metropolitan Council's Regional Blueprint is threatened when there is a lack of synchronicity amoung Regional System Plans; and WHEREAS, the Metropolitan Council does not have a policy which prohibits an expansion of CR 46 through Murphy-Hanrehan Park Reserve; and WHEREAS, the Metropolitan Council does not have a procedure to address conflicts between competing Metropolitan System Plans. • NOW THEREFORE BE IT RESOLVED by the City Council of the City of Lakeville that: 1. The City recognizes and concurs in the present Metropolitan Council Functional Classification Spacing Criteria which calls for a principle arterial every two (2) to three (3) miles in fully developed areas and every three (3) to six (6) miles in developing areas. The City also concurs in the the following Finding of Fact on Functional Classification in the CSAH 42 Corridor Study, prepared by BRW and dated November 6, 1997 which states: Northern Dakota and Scott Counties are both developing. Compliance with the Metropolitan Council Functional Classification Spacing Criteria would call for an east-west principle arterial at Cliff Road and another at CSAH 42.... County Road 46 lacks continuity across both Dakota and Scott Counties. The Murphy-Hanrehan Park Reserve is a formidable barrier to any principle roadway west of Lakeville. To the east of Lakeville, the Metropolitan Council does not envision CR 46 as a principle arterial because much of the required area to be traversed is outside the MUSA in the permanent agricultural area which is outside the 2040 urban reserve boundary. 2. Despite this Finding, participants in the CSAH 42 Corridor Study have, from time to time, recommended using enhancements to CR 46 as an alternative mitigating measure to alleviate the congestion on CSAH 42 and to provide an east-west corridor through Dakota and Scott Counties. • a 3. The City of Lakeville is opposed to using County Road 46 in any manner to develop an alternative mitigating measure to solve the present problems associated with CSAH 42 as a principle arterial roadway. 4. Any suggestion that CR 46 be considered as an alternative is both short sighted, environmentally insensitive and irresponsible. Any extension of CR 46 west of CR 5 intentionally ignores and disregards the impact such a proposal would have on existing development along CR 46 and the adverse impact such a proposal would have on Murphy-Hanrehan Park Reserve. 5. Murphy-Hanrehan Park Reserve was included in the Regional Park System because of the uniqueness of its natural features. The importance of protecting this park land dates back to the early 1970's when the Metropolitan Council identified Murphy-Hanrehan as an "immediate action site" and allocated monies for its acquisition. 6. Any development of CR 46 west of I-35 and through Murphy-Hanrehan Park Reserve would significantly impair the unique geologic resources and protected habitat the Park Reserve was established to protect. 7. The City concurs with Suburban Hennepin County Regional Park District Resolution 96-1 which provides that: The Scott-Hennepin Park Advisory Board opposes the construction of any new roadway or expansion of existing roadway through the Murphy- Hanrehan Park Reserve. 8. The Metropolitan Council should take aggressive steps to assure the integrity of its Regional Blueprint and its Regional System Plans and it should protect the environment from expedient solutions that pit environmentally sensitive and responsible communities against those willing to sacrifice the environment for the benefit of economic development.
