RESOLUTION VACATING A WATERMAIN EASEMENT

WHEREAS, the Planning Commission has conducted a public hearing, preceded
by two (2) weeks published notice, to consider the following described watermain
easement vacation, and
WHEREAS, the City Council has determined that it is in the public interest to
approve the watermain easement vacation.
NOW, THEREFORE, BE IT RESOLVED by the Lakeville City Council:
1. The following watermain easement is hereby vacated:
(see attached Exhibit A)
2. The City Clerk is directed to file a certified copy of this resolution with the Dakota
County Recorder.
APPROVED .AND ADOPTED this 2nd day of June, 1997.

WATER MAIN EASEMENT TO BE VACATED
Watermain easement agreement dated May 21, 1979 and recorded Apri130, 1987 as Document No. 780351.
Said easement describes a 20.00 foot perpetual easement for watermain purposes over, under and across part of
the East half of the Southeast Quarter of Section 5, Township 114, Range 20, Dakota County, Minnesota which lies
10.00 feet on each side of a described centerline. That portion of the above referenced easement to be vacated lies
within the Southeast Quarter of the Southeast Quarter of said Section 5 and 10.00 feet on each side of the following.
described centerline:
Commencing at a point on the East line of the East half of the Southeast Quarter of said Section 5 distant 10.00
feet north of the Northeast comer of the Southeast Quarter of the Southeast Quarter of said Section 5; thence
on an assumed bearing of South 89 degrees 32 minutes 10 seconds West, parallel with the North {ine of said
Southeast Quarter of the Southeast Quarter, a distance of 290.00 feet; thence South 1 degree 16 minutes 19
seconds East, parallel with the East line of said Southeast Quarter of the Southeast Quarter, a distance of 10.00
feet to said North line of the Southeast Quarter of the Southeast Quarter and the actual point of beginning of the
centerline to be described; thence continuing South 1 degree 16 minutes 19 seconds East a distance of 360.14
feet; thence southwesterly a distance of 190.04 feet along a tangential curve concave to the northwest having a
radius of 359.55 feet and a central angle of 30 degrees 17 minutes 02 seconds; thence South 29 degrees 00
minutes 43 seconds West a distance of 524.86 feet; thence southwesterly a distance of 260.60 feet along a
tangential curve concave to the northwest having a radius of 245.27 feet and a central angle of 60 degrees 52
minutes 41 seconds; thence South 89 degrees 53 minutes 24 seconds West, parallel with the South line of said
Southeast Quarter of the Southeast Quarter, a distance of 130.00 feet; thence northwesterly a distance of
• 160.51 feet along a tangential curve concave to the northeast having a radius of 194.21 feet and a central angle
of 47 degrees 21 minutes 18 seconds; thence South 44 degrees 17 minutes 34 seconds West, not tangent to
last described curve, a distance of 325.64 feet to a point 20.00 feet north of the South fine of said Southeast
Quarter of the Southeast Quarter; thence South 89 degrees 53 minutes 24 seconds West, parallel with said
South line of the Southeast Quarter of the Southeast Quarter, a distance of 6.00 feet, more or less, to the West
line of said Southeast Quarter of the Southeast Quarter and said centerline there terminating.
