RESOLUTION

RESOLUTION APPROVING THE FINAL PLAT OF
RAVEN LAKE SECOND ADDITION AND
THE CONVEYANCE OF CITY OWNED PROPERTY
WHEREAS, the owner of the plat described as Raven Lake Second Addition has
requested final plat approval; and
WHEREAS, the final plat was reviewed by the Planning Commission, the
Environmental Affairs Committee, and the Parks and Recreation Committee; and
WHEREAS, the final plat is acceptable to the City; and
WHEREAS, the Raven Lake Second Addition development agreement provides
that certain real property owned by the City be conveyed to the developer, T.N.C., Inc.,
and shall constitute part of the final plat; and
WHEREAS, the terms of the conveyance of the City owned property as outlined
in the development agreement are fair and reasonable; and
WHEREAS, maintaining ownership of the City owned property would not serve
the public interest; and
WHEREAS, the proposed conveyance of the City owned property pursuant to
the development agreement has no relationship to the City's Comprehensive Plan.
NOW, THEREFORE, BE IT RESOLVED by the Lakeville City Council
1. The final plat of Raven Lake Second Addition is hereby approved subject to
the developer's execution of the development agreement and bond
requirements.
2. The Mayor and City Clerk are hereby directed to sign the development
agreement, the Minngasco easement agreement, the conservation easement
• agreement, and the quit claim deed conveying the City owned property.
• 3. The City Clerk is directed to file a certified copy of this resolution with the
Dakota County Recorder.
4. The requirements of Minn. Stat. S 462.356 are hereby dispensed with as the
same relate to the City owned property and the development agreement.
5. City staff is authorized to complete the transaction of the City owned property
pursuant to the terms of the development agreement.
