RESOLUTION FOR VACATION OF A PERMANENT UTILITY EASEMENT
WHEREAS, the Planning Commission has conducted a public hearing, preceded
by two weeks published notice, to consider vacating an existing permanent sewer and
water utility easement created by Quit Claim Deed dated September 22, 1988, recorded
August 14, 1989 as Document No. 218925; and
WHEREAS, the City Council has determined that it is in the public interest to
vacate said easement.
NOW, THEREFORE, BE IT RESOLVED by the Lakeville City Council:
1. The permanent sewer and water utility easement created by Quit Claim Deed dated
September 22, 1988; recorded August 14, 1989 as Document No. 218925 is hereby
vacated:
(SEE ATTACHED SCHEDULE "A")
2. All easements granted or dedicated with the final plat of Kabot Cove shall not be
affected by this Resolution and shall be reserved by the City.
3. The City Clerk is directed to file a certified copy of this resolution with the County
Recorder.
ADOPTED by the Lakeville City Council this 3rd day of March, 1997.

• The land referred to in this easement is located in the County of
Dakota, State of Minnesota, and described as follows:
That part of Government Lot 1, Section 13, Township 114, Range
21, Dakota County, Minnesota, described as follows: Commencing
at the Intersection of the south line of Section 13, with the
Government meander line in said Government Lot 1; thence North
50 degrees West on said Government Meander line a distance of
96.4 feet to the actual point of beginning of the land to be
