RESOLUTION

RESOLUTION VACATING_STREET DRAINAGE, AND UTILITY EASEMENTS
WHEREAS, the Planning Commission has conducted a public hearing, preceded
by two (2) weeks published notice, to consider the following described street, drainage,
and utility easement vacation, and
WHEREAS, the City Council has determined that it is in the public interest to
approve the street, drainage, and utility easement vacation.
NOW, THEREFORE, BE IT RESOLVED by the Lakeville City Council:
1. The following street, drainage, and utility easements are hereby vacated:
(see attached Exhibit A)
2. The City Clerk is directed to file a certified copy of this resolution with the Dakota
County Recorder.
APPROVED AND ADOPTED this 7th day of July, 1997.

DESCRIPTION
Of the West 50 feet of the South half of the Southwest
Quarter of .the Northwest Quarter, and the West 50 feet of the
North half of the Northwest Quarter of the Southwest Quarter,
Section 4, Township 114, Range 20, Dakota County, Minnesota,
originally described as a right of way easement for Highview
Avenue, to be vacated together with all described and or implied.
easements attached to the aforementioned easement.
DESCRIPTION
• Qf a 40 foot wide strip, originally dedicated as a perpetual
easement for street, drainage and utility purposes, tv be vacated
together with all described and or implied temporary easements
attached to the herein easement, being the south 40.0 feet of the
west 1000.0 feet of the South 1/2 of the South 1/2 of the
Southwest 1/4 of the Northwest 1/4 of Section 4, Township 114,
Range 20, Dakota County., Minnesota. Except the west 50.0 feet
thereof .
DESCRIPTION

DESCRIPTION
Of a pexpetual easement for drainage purposes, to be vacated
together with all described and or implied temporary easements
attached to the herein described easement, being that part of the
South 1/2 of the South 1/2 of the Southwest 1/4 of the Northwest
1i4 of Section 4, Township 114, Range 20, Dakota County,
Minnesota described as follows: Commencing at the southwest
corner of said South 1/2 of the South 1/2 of the Southwest 2/4 of
the Northwest 1/4; thence east along the south line of the South
1/2 of the South 1/2 of the Southwest 1/4 of the Northwest l/4, a
distance of 235.0 feet; thence northerly deflecting 90 degrees
left, a distance of 40 feet to the point of beginning herein;
thence continuing along the last described course, a distance of
60 feet; thence northwesterly. deflecting 48 degrees 45 minutes
left, a distance of 135.0 feet; thence northerly deflecting 48
degrees 45 minutes right, a distance of 300.0 feet; thence
easterly deflecting 90 degrees right, a distance of 185.0 feet;
thence southeasterly deflecting 41 degrees 23 minutes 54 seconds
• right, a distance of 421.92 feet; thence southerly deflecting 48
degrees 36 minutes 06 seconds right, a distance of 170.0 feet to
a line parallel with and 40 feet north of said south line of the

1/4; thence westerly along said parallel line, a distance of
400.0 feet to the point of beginning herein.
