RESOLUTION NO. 97-155 MOTION BY Johnson SECONDED BY Holberg RESOLUTION APPROVING THE FINAL PLAT OF TARRY CREEK AND THE CONVEYANCE OF CITY OWNED PROPERTY WHEREAS, the owner of the plat described as Tarry Creek has requested final plat approval; and WHEREAS, the final plat was reviewed by the Planning Commission, the Environmental Affairs Committee and the Parks and Recreation Committee; and WHEREAS, the final plat is acceptable to the City. WHEREAS, the Tarry Creek development agreement provides that certain real property owned by the City be conveyed to the developer, Tarry Creek, LLC, and shall constitute part of the final plat; and WHEREAS., the terms of the conveyance of the City owned property as outlined in the development agreement are fair and reasonable; and WHEREAS, maintaining ownership of the City owned property would not serve the public interest; and WHEREAS, the proposed conveyance of the City owned property pursuant to the development agreement has no relationship to the City's Comprehensive Plan. NOW, THEREFORE, BE IT RESOLVED by the Lakeville City Council: 1. The final plat of Tarry Creek is hereby approved subject to the developer's execution of the development contract and bond requirements. 2. The wetland replacement plan is hereby approved in accordance with WCA. 3. The Mayor and City Clerk are hereby directed to sign the development contract, warranty deed, and temporary turnaround easement agreement. 4. The City Clerk is directed to file a certified copy of this resolution with the Dakota County Recorder. 5. The requirements of Minn. Stat. S 462.356 are. hereby dispensed with as the same relate to the City owned property pursuant to the development agreement. 6. City staff is authorized to complete the transaction of the City owned property pursuant to the terms of the development agreement. APPROVED AND ADOPTED this 7th day of July, 1997.
