WHEREAS, it is proposed that Airlake Development, Inc. and the City transfer and exchange property within the City legally described as: PARCEL A: City Parcel to Airlake Development, Inc. .That part of the SE'/. of the NE'/. of Section 33, Township 114, Range 20, Dakota County, Minnesota, described as follows: Beginning at the southeast comer of the NE'/. of said Section 33; thence West, • assumed bearing, on the south line of the SE'/. of the NE'/. a distance of 277.30 feet; thence North 00 degrees 45 minutes 30 seconds East a distance of 280.00 feet; thence East parallel with the south line of the SE'/. of the NE'/. a distance of 276.51 feet to the east line of the SE'/. of the NE'/.;thence South 00 degrees 35 minutes 45 seconds West on the east line of the SE'/. of the NE'/, a distance of 279.99 feet to the point of beginning. PARCEL B: Airlake Development, Inc. Parcel to City That part of Outlot B, AIRLAKE DEVELOPMENT ADDITION, Dakota County, Minnesota, according to the recorded plat thereof, described as follows:. Beginning at the southeast corner of said Outlot B; thence West, assumed bearing, along the south line of said Outlot B a distance of 329.65 feet; thence North 68 degrees 01 minutes 25 seconds West along the southwesterly line of said Outlot B a distance of 348.55 feet; thence North 87 degrees 41 .minutes 01 seconds East a distance of 600.71 feet; thence South 45 degrees 46 minutes 07 seconds East a distance of 75.12 feet to the east line of said Outlot B; thence South 00 degrees 38 minutes 53 seconds West along the east line of said Outlot B a distance of 102.32 feet to the point of beginning. WHEREAS, the City and Airlake Development, Inc. are exchanging property to facilitate the overall development of Airlake Industrial. Park and the City Public Works property; and WHEREAS, the exchange of properties described above shall be finalized without further consideration being paid to either the City or Airlake Development, Inc.; and WHEREAS, the terms of the even exchange of properties are fair and reasonable. NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Lakeville:. 1. That the exchange of the Property by the City to Airlake Development, Inc. and Airlake Development, Inc. to the City has no relationship to the City's Comprehensive Plan. Subject to the conditions set forth below the Mayor and City Clerk are authorized to execute and deliver a Deed for the City Property (Parcel A) and all other documents necessary to complete the transfer, in exchange for a fully executed Deed from Airlake Development, Inc. to the City. 4. The closing of the transaction described above shall not occur until the title to the parcels described above has been reviewed and approved by the city attorney. ADOPTED this 6th .day of May, 1996, by the City Council of the City of Lakeville.
