RESOLUTION AUTHORIZING ACQUISITION OF PROPERTY
INTERESTS FOR SANITARY SEWER PROJECT NO. 96-3
FARMINGTON ELEMENTARY SCHOOL
WHEREAS, the City Council of the City of Lakeville does hereby determine that
it is necessary and for a public use and purpose to acquire a permanent sanitary sewer
easement and the sanitary sewer lines located therein as identified and described on the
legal description and drawing attached hereto as Exhibits A and B for Project 96-3,
• Farmington Elementary School; and
WHEREAS, the City Council finds that the construction schedule and seasonal
construction conditions make it necessary to acquire title to, and possession of, the subject
property as soon as possible in order for Project 96-3 to proceed in an efficient, cost
effective and expeditious manner;
NOW, THEREFORE, be it resolved by the City Council of the City of Lakeville,
Minnesota:
1. That the City Attorney is authorized to commence eminent domain
proceedings pursuant to Minnesota Statute Chapter 117 to acquire the property interests
described on Exhibit "A" in order to proceed with City Project 96-3.

2. That the City Attorney is authorized to acquire the necessary property
interests pursuant to the "quick take" provisions of Minnesota Statute § 117.042.
3. That the Mayor and the City Clerk are authorized to execute all documents
necessary, in the opinion of the City Attorney, to effect the acquisition of the necessary
property interests .
ADOPTED this 5th day of February , 1996, by the City Council of the
City of Lakeville.

• EXHIBIT "A"
A perpetual easement for sanitary sewer purposes over, under, and across that part of the
above described parcel which lies within the following described strip of land:
The part of the Southeast Quarter of the Northeast Quarter and the Southwest
Quarter of the Northeast Quarter of Section 11, Township 114 North, Range 20
West, Dakota County, Minnesota, which lies within a 20.00 foot wide strip of land
10.00 feet on each side of the following described centerline:
Commencing at the northeast corner of said Section 11; thence on an
assumed bearing of South 0 degrees 15 minutes 17 seconds West along the
east line of the Northeast Quarter of said Section 11 a distance of 1309.16
feet to the northeast corner of the Southeast Quarter of the Northeast
Quarter; thence South 89 degrees 34 minutes 20 seconds West 1302.76 feet
along the north line of said Southeast Quarter of the Northeast Quarter to
a point 30.00 feet easterly of the northeast corner of the Southwest Quarter
of the Northeast Quarter as measured along said north line; thence South
0 degrees O1 minutes 03 seconds West 10.00 feet along a line parallel with
the east line of said Southwest Quarter of the Northeast Quarter to the point
of beginning of the centerline to be described; thence South 89 degrees 34
minutes 20 seconds West 30.00 feet along a line parallel with the north line
of said Southeast Quarter of the Northeast Quarter to the east line of said
Southwest Quarter of the Northeast Quarter; thence continuing 89 degrees
34 minutes 20 seconds West 207.15. feet along a line parallel with the north
line of said Southwest Quarter of the Northeast Quarter; thence South 0
degrees 35 minutes 24 seconds East 405.07 feet; thence South 53 degrees
46 minutes 44 seconds West 98.67 feet; thence North 73 degrees 49
minutes 07 seconds West 213.70 feet; thence South 15 degrees 56 minutes
56 seconds West 190.16 feet and said centerline there terminating.
Said easement contains 19,000 square feet, more or less, exclusive of existing City
property.
The property interests also include the sanitary sewer lines located within the above-
described easement premises.
