HomeMy WebLinkAbout96-003 • CITY OF LAKEVILLE DAKOTA COUNTY, MINNESOTA RESOLUTION Date January 2, 1996 Resolution No. 96-3 Motion By Johnson Seconded By Mulvihill RESOLUTION AUTHORIZING CONDEMNATION OF PROPERTY FOR PARK PURPOSES WHEREAS, the City Council of the City of Lakeville does hereby determine that it is necessary and for a public use and purpose to acquire the property described on the attached Exhibit "A" for public park land; and WHEREAS, the City Council finds that development and construction • nit' v 1 ke it nec s ar to ac uire title to and co d ions related to de e opment of the area ma e s y q , possession of, the subject property as soon as possible in order for development to proceed in an efficient, cost effective and expeditious manner; NOW, THEREFORE, be it resolved by the City Council of the City of Lakeville, Minnesota: 1. That the City Attorney is authorized to commence eminent domain proceedings pursuant to Minnesota Statute Chapter 117 to acquire fee title to the property described on the attached Exhibit "A" . 2. That the City Attorney is authorized to acquire the necessary property interests pursuant to the "quick take" provisions of Minnesota Statute § 117.042. • 21427 . 3. That the Mayor and the City Clerk are authorized to execute all documents necessary, in the opinion of the City Attorney, to effect the acquisition of the necessary property interests. Zaun, M r Charlene Friedges, Cit Clerk • 21427 -2- EXHIBIT "A" The East One-Half (E 1 /2) of the Northwest Quarter (NW 1 /4) and the West One-Half (W 1 /2) of the Northeast Quarter (NE 1 /4) all in Section Seventeen (17), Township One Hundred Fourteen (114), Range Twenty (20), excepting therefrom that part of the West One-Half (W 1 /2) of the Northeast Quarter (NE 1 /4) described as follows Commencing at the southeast corner of the West One-Half (W 1/2) of the Northeast Quarter (NE 1 /4) of said Section Seventeen (17) thence west 440 feet, thence northeasterly to a point on the east line of the West One-Half (W 1/2) of the Northeast Quarter (NE 1/4) of said Section Seventeen (17), which point is 334 feet north of the point of beginning, containing 1.69 acres, more or less. ALSO EXCEPTING THEREFROM that part of the East One-Half (E 1 /2) of the North~~~est Quarter (NW 1 /4) and that part of the West One-Half (W 1 /2) of the Northeast Quarter (NE 1 /4) lying northerly and westerly of the center of County Road No. 9 (Dodd Blvd.) as travelled. ALSO EXCEPTING THEREFROM that portion of the West One-Half (W 1/2) of the Northeast Quarter (NE 1/4) of said Section Seventeen (17) which constitutes the most northerly ten acres of the West One-Half (W 1/2) of the Northeast Quarter (NE 1 /4) lying southeasterly of the southeasterly right of way line of County Road No. 9 (Dodd Blvd.) • 21427 -3-
