RESOLUTION

RESOLUTION AUTHORIZING CONDEMNATION
OF PROPERTY FOR PUBLIC PURPOSES
WHEREAS, the City Council of the City of Lakeville does hereby determine
that it is necessary and for a public use and purpose to acquire the property described
on the attached Exhibit "A" for public park land, road right-of--way, trailway and
utility purposes; and
WHEREAS, the City has been unable to acquire the property through
negotiation with the landowner; and
WHEREAS, the City Council finds that development and construction
conditions related to development of the area make it necessary to acquire title to, and
possession of, the subject property as soon as possible in order for development to
proceed in an efficient, cost effective and expeditious manner;
NOW, THEREFORE, be it resolved by the City Council of the City of
Lakeville, Minnesota:
1. That the City Attorney is authorized to commence eminent domain
proceedings pursuant to Minnesota Statute Chapter 117 to acquire fee title to the

• property described on the attached Exhibit "A" .
2. That the City Attorney is authorized to acquire the necessary property
interests pursuant to the "quick take" provisions of Minnesota Statute § 117.042.
3. That the Mayor and the City Clerk are authorized to execute all
documents necessary, in the opinion of the City Attorney, to effect the acquisition of
the necessary property interests.
ADOPTED this 6th day of March 1995, by the City Council of
the City of Lakeville.

The East 2000.00 feet of the South 1140.00 feet of the South Half of the
Northeast Quarter of Section 16, Township 114 North, Range 20 West, Dakota
County, Minnesota,
and
The East 2000.00 feet of the North 13.333 rods of the North Half of the
Southeast Quarter of Section 16, Township 114 North, Range 20 West, Dakota
County, Minnesota,
Except that part of the above-described parcels which lies within the public
right-of--way of C.S.A.H. No. 23 also known as Cedar Avenue.
