RESOLUTION

RESOLUTION AUTHORIZING CONDEMNATION
OF PROPERTY FOR PARK PURPOSES
WHEREAS, the City Council of the City of Lakeville does hereby determine
that it is necessary and for a public use and purpose to acquire the property described
on the attached Exhibit A for public park land; and
WHEREAS, the City has been unable to acquire the property through
• negotiation with the landowner; and
WHEREAS, the City Council finds that development and construction
conditions related to development of the area make it necessary to acquire title to, and
possession of, the subject property as soon as possible in order for development to
proceed in an efficient, cost effective and expeditious manner;
NOW, THEREFORE, be it resolved by the City Council of the City of
Lakeville, Minnesota:
1. That the City Attorney is authorized to commence eminent domain
proceedings pursuant to Minnesota Statute Chapter 117 to acquire fee title to the
property described on the attached Exhibit A.

EXHIBIT A
Parcel 1 - Barte
Lot 6, Block 1, Sullivan's .First Addition to Marion Heights, Dakota .County,
Minnesota.
Parcel 2 - Tutewohl
The Northerly 1500 feet of the West One-Half of the Southwest Quarter of
Section 1, Township 114, Range 20 West, Dakota County, Minnesota.
Parcel 3 - Grebner
J~eginning at the intersection of the westerly line of Section 30, Township 114,
Range 20 and the northerly boundary of the right-of--way of the Chicago,
Milwaukee and St. Paul Railroad; thence northerly along the westerly line of
said Section 30 a distance of 366 feet to the shore line of Prairie. Lake; thence
east 20 feet to the center of the Township Road; thence southeasterly along the
aforesaid road 422 feet to the right-of--way of the Chicago, Milwaukee and St.
Paul Railroad; thence West 217 feet to the place of beginning, EXCEPT ail that
part thereof lying south of 205th Street West (also known as C.S.A.H. No. 64),
Dakota County, Minnesota, according to the Government Survey thereof.

• 2. That the City Attorney is authorized to acquire the necessary property
interests pursuant to the "quick take" provisions of Minnesota Statute § 117.042.
3. That the Mayor and the City Clerk are authorized to execute all
documents necessary, in the opinion of the City Attorney, to effect the acquisition of
the necessary property interests.
ADOPTED this 6th day of February 1995, by the City Council of
the City of Lakeville.
