HomeMy WebLinkAbout94-106 • CITY OF LAKEVILLE DAKOTA COUNTY, MINNESOTA RESOLUTION DATE May 16, 1994 RESOLUTION NO. 94-106 Harve MOTION BY Sindt SECONDED BY y RESOLUTION ADOPTING ASSESSMENTS FOR IMPROVEMENT PROJECT 89-1 HIGHWAY RECONSTRUCTION ON CEDAR AVENUE, 160TH STREET WEST AND DODD BOULEVARD WHEREAS, pursuant to proper notice duly given as required by law, the Council has met, heard and passed upon all objections to the proposed assessment for the Southwest segment of Improvement Project 89-1 to be deferred with interest. NOW, THEREFORE, BE IT RESOLVED by the City Council of Lakeville, Minnesota: 1. Such proposed assessment No. 692 in the amount of $24,604.43, a copy of which is attached hereto and made apart hereof, is hereby accepted and shall constitute the special assessment against the lands named therein, and each .tract of land therein included is hereby found to be benefited by the proposed improvement in the amount of the assessment levied against it. 2. Such assessments shall be deferred with 7.8605 % interest per year on the unpaid balance. Interest shall accrue from the date of this assessment resolution. The deferment shall end and the first installment shall be payable in the year .following the year when the property is "developed" . "Developed" means that a building permit has been issued for the property or the property is platted, further subdivided or consolidated with another parcel. When the deferment ends, the assessment shall be spread over twenty (20) years or such lesser number of years that the final installment shall be due and payable no later than thirty (30) years after this assessment resolution is adopted. 3. The owner of any property so assessed may, at any time prior to • certification of the assessment to the County Auditor, pay the whole of the assessment on such property, with interest accrued to the date of payment, to the • RF{SOLUTION, CONT. PAGE TWO City Treasurer, except that no interest shall be charged if the entire assessment is paid within thirty (30) days from the adoption of this resolution; and he or she may, at any .time thereafter, pay to the Ciry Treasurer the entire amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in which such payment is made. Such payment must be made before December 31, 1994, or interest will be charged through December 31 of the succeeding year. 4. The City Clerk shall forthwith transmit a certified duplicate of this assessment to the County Auditor to be extended on the proper tax lists of the County, and such assessments shall be collected and paid over in the same manner as other municipal taxes.
