HomeMy WebLinkAbout94-092 • CITY OF LAKEVILLE RESOLUTION Date May 2, 1994 Resolution No. 94-92 Motion by Harvey Seconded by Mulvihill RESOLUTION DETERMINING THE NECESSITY OF ISSUING GENERAL OBLIGATION PARK BONDS AND CALLING A SPECIAL ELECTION THEREON BE IT RESOLVED by the City Council of the City of Lakeville, Minnesota, as follows: 1. This Council has investigated the facts necessary to ascertain and does hereby find, determine and declare that it is necessary and expedient for the City to borrow money by the issuance of its general obligation bonds in an amount not to exceed $3 675,000. to provide funds for the acquisition and betterment of park and trail facilities. • 2. The question of issuing bonds in such an amount and for such urpose shall be submitted to the vote of the qualified electors of the ~ity at a special election to be held on June 28, 1994, at the .polling places set forth in the notice of the special election described in paragraph 4 hereof. 3. The City Clerk is hereby authorized and directed to cause notice of the special election to be given as follows: (A) by immediately posting in the Clerk's office for public inspection a copy , of the notice set forth in paragraph 4; (B) by publication of the nonce of special election in the official newspaper of the City, once each week for two successive weeks, the first publication to be not less than fourteen days before the special election; (C) by publishing in the official newspaper of the City a sample ballot as set forth in paragraph 5 at least one week before the special election; and (D) by posting a sample ballot in the Clerk's office for public inspection at least four days before the special election and in each polling place on election day. 4. The notice of s ecial election to be ppublished and posted as rovided in paragraph 3 ~A) and (B) above shaIl be in substantially the ~ollowing form: 5. The sample ballot for the special election shall be posted and published as provided in paragraph 3 (C) and (D) and shall be in substantially the following form: CITY OF LAKEVILLE MINNESOTA SPECIAL ELE~TION June 28, 1994 YES Shall the City of Lakeville, Minnesota, be authorized to borrow money by the issuance of general obligation bonds of the City NO in an amount not to exceed $3,675,000 for the acquisition and betterment of park and trail facilities? BY VOTING "YES" ON THIS BALLOT QUESTION, YOU ARE VOTING FOR A PROPERTY TAX INCREASE The maximum amount of the increased tax levy, as a percentage of market value is .025 % and the amount that will be raised by the new tax rate in the first year to be levied (1995) is $265,949. INSTRUCTIONS TO VOTERS: If you wish to vote in favor of the above proposition, mark an "X" in the square preceding the word YES. If you wish to vote against the above propposition, mark an "X" in the square preceding the word NO next to tFie proposition. 6. The Cit Clerk is authorized and directed to cause official ballots to be printed for the use of the voters at the sppecial election, which shall be printed on blue-colored pa er and shall be identical in form with the sample ballot in paragraph ~ above, exce t that the first line of the official ballot shall read 'OFFICIAL BALLO~", and on the back, so as to be visible when the ballot is ro~erly folded for deposit, shall be printed the words "OFFICIAL BALL~T ,the date of the special election and the lines for the initials of two judges. 7. The s~ppecial election shall be .held and conducted in the manner prescribed by ,law. This Council shall meet on June 29, 1994 at 7:00 PM as a canvassing board and declare the results appearing from the special election returns, in accordance with law. DATED this 2nd day of May, 1994.
