RESOLUTION CONCERNING FISCHER SAND AND GRAVEL
MINING SOUTH OF COUNTY ROAD 42
WHEREAS, since 1988 the City of Lakeville has closely
monitored, evaluated, and expressed its concerns about the proposed
gravel mining operation between County Road 42 and County Road 46
in Apple Valley; and
WHEREAS, the City has presented compelling evidence that the
proposed gravel mining operation will damage the environment, be
detrimental to present and future residents of the area, and
disrupt or prevent land use development in Lakeville consistent
with the Lakeville Comprehensive Plan; and
WHEREAS, the Apple Valley City Council has approved an
environmental impact statement, a comprehensive plan amendment
(subject to Metropolitan Council approval), a rezoning and
• conditional use permit to allow the proposal to proceed.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Lakeville:
1. Pursuant to Minn. Stat. § 473.174, the City Attorney is
directed to request the Metropolitan Council to
critically evaluate the impact of changes in use upon
Metropolitan's systems and existing and planned develop-
ment in adjoining communities, and to conduct a hearing
on the proposed comprehensive plan amendment at which all
concerned and impacted parties can present their views.
2. The City Administrator, City Attorney, and the City's
planning consultant are directed to explore appropriate
steps that may be taken to prevent the gravel mining
expansion from proceeding or to mitigate its impact.
ADOPTED this 7th day of June , 1993, by the City
Council of the City of Lakeville.
