HomeMy WebLinkAbout93-039 CITY OF LAKEVILLE • RESOLUTION Date March 1, 1993 Resolution No. 93-39 Motion by .Harvey Seconded by Ruhmann RESOLUTION ESTABLISHING A PROGRAM TO IDENTIFY NON-CONFORMING INDIVIDUAL SEWAGE TREATMENT SYSTEMS WITHIN THE SHORELAND OVERLAY DISTRICT WHEREAS, the City of Lakeville recognizes the need for all individual sewage treatment systems to be in compliance with the Shoreland regulations and as such, will require upgrading or replacement of any non-conforming system within a period not to exceed two years; and WHEREAS, the City Council has established an ordinance requiring those properties which have sewer and water utilities available but are not hooked up, shall be required to be connected to sewer and water within two years of notification; and WHEREAS, the City is required to notify the Commissioner of the Department of Natural Resources of its program to identify non-conforming individual sewage treatment systems. The City of Lakeville will adopt the following policy to address • this issue. Now, therefore, be it resolved by the City Council of the City of Lakeville: 1. The City of Lakeville will require that the individual sewage treatment system on all lots be inspected for compliance with the Shoreland regulations as pant of all variance, conditional use and building permit applications within the Shoreland Overlay District. 2. The City will identify all lots with individual sewage treatment systems within the Shoreland Overlay District outside the Urban Service Area and notify the same by certified mail requiring reconstruction of non-conforming septic systems when practical, conditioned that the site area can accommodate required setbacks for an individual sewage treatment system.
