HomeMy WebLinkAbout92-083 CITY OF LAKEVILLE RESOLUTION Date May 18, 1992 Resolution No. 92-83 Motion by Harvey Seconded by Mulvihill RESOLUTION FOR VACATION OF A DRAINAGE AND UTILITY EASEMENT WHEREAS, the Planning Commission has conducted a public hearing, preceded by two weeks published notice, to consider vacating the following described drainage and utility easement; and WHEREAS, the City Council has determined that it is in the public interest to vacate the easement. NOW, THEREFORE, BE IT RESOLVED by the Lakeville City Council: 1. The following drainage and utility easement is hereby vacated: The drainage and utility easement lying five feet each side and adjacent to the common lot line between Lots 8 and 9, Block 2, Great Oak Shores, according to the recorded plat thereof. Z. The above described drainage and utility easement is vacated subject to the following conditions: a. Approval of an administrative subdivision for the reconfiguration of Lots 8 and 9, Block 2, Great Oak Shores as shown on the Certificate of Survey dated March 25,1992 by Kurth Surveying, Inc. b. The dedication of a ten foot drainage and utility easement centered along the new shared property boundary between hots 8 and 9, Block 2, Great Oak Shores. c. The submission of a tree preservation plan for Lots 8 and 9, Block 2, Great Oak Shores prior to building permit application. 3. The City Clerk is directed to file a certified copy of this resolution. with the County Recorder. ADOPTED by the Lakeville City Council this 18th day of May, 1992.
