HomeMy WebLinkAbout90-178 f j CITY OF LAKEVILLE DAKOTA COUNTY, MINNESOTA RESOLIITION Date December 17, 1990 Resolution No. 90-178 Motion By Sindt Seconded By Ruhmann WHEREAS, the City has attempted without success to have the owner of certain property correct the inadequately maintained, dilapidated, and unsanitary condition of the property; and WHEREAS, the City has determined that the property constitutes a hazardous building within the meaning of Minnesota Statutes § 463.15, Subd. 3. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lakeville: 1. Pursuant to Minnesota Statutes § 463.17 et seq. the City hereby adopts. and approves the Order attached hereto as Exhibit "A". 2. The City's legal counsel, Roger N. Knutson, Campbell, Knutson, Scott & Fuchs, P.A., 3460 Washington Drive, Suite 202, Eagan, Minnesota 55122, is directed to serve the Order and to proceed with enforcement in accordance with Minnesota Statutes § 463.15 et seq. Please be advised that pursuant to order of the Lakeville City Council and by authority of Minnesota Statutes § 463.15 et sec., you have twenty (20) days from the date of service of this Order upon you, to remedy the hazardous condition of your house situated on property at 10049 - 210th Street West in the City of Lakeville, Dakota County, • Minnesota, legally described as follows: The South 242 feet of the East 450 feet of the Southeast Quarter of the Southwest Quarter of Section 30, Township 114, Range 20, Dakota County, Minnesota, EXCEPT the East 30 feet to City. The building as it is presently situated in its inadequately maintained, dilapidated, and unsanitary condition constitutes a health, safety, and fire hazard to the residents of the City of Lakeville. In order to remedy the situation you must remove all animal feces, garbage, junk, and filth; clean, sanitize,. and deodorize the property. If you fail to remedy the situation the City will seek .permission from the District Court for the City to do so. The City will make a motion for summary enforcement of this order before the District Court pursuant to Minnesota Statutes § 463.19 unless you correct the EXHIBIT "A" condition within the twenty (20) day period or unless an answer is filed within twenty (20) days of service of this Order upon you.
