RESOLUTION REQUESTING A PERPETUAL EASEMENT FROM THE
MINNESOTA DEPARTMENT OF NATURAL RESOURCES FOR STREET,
DRAINAGE AND UTILITY PURPOSES IN CONJUNCTION WITH THE
PLAT OF LAKE VILLA GOLF ESTATES 6TH ADDITION
WHEREAS, Eva Development, Inc. has received preliminary plat
approval for Lake Villa Golf Estates 6th Addition, contingent upon
obtaining an easement from the Minnesota Department of Natural
Resources ("DNR") for street drainage and utility purposes, before
receiving final plat approval; and
• WHEREAS, Eva Development, Inc. is in the process of
negotiating a land trade with DNR whereby Eva Development, Inc. will
obtain fee title to the easement property upon completion of the
trade; and
WHEREAS, the DNR has indicated that completion of the land
trade may take six (6) months to one year; and
WHEREAS, Eva Development, Inc. anticipates it will be seeking
final plat approval before the land trade is completed; and
WHEREAS, the DNR mandates that the City of Lakeville must be
the requesting party for an easement in favor of the City; and
WHEREAS, Eva Development, Inc. has agreed to pay any costs
associated with acquiring the easement.

NOW, THEREFORE, BE IT RESOLVED by the Lakeville City Council
as follows:
1. The City of Lakeville hereby requests the DNR to grant
the City a perpetual easement for street, drainage, and utility
purposes on the following described parcels in the City of Lakeville,
County of Dakota, State of Minnesota: See Exhibit "A" attached.
ADOPTED this 2nd day of April , 1990, by the City
Council of the City of Lakeville.
