RESOLUTION NO. 90-33
A RESOLUTION APPROVING A
MODIFICATION TO THE DOWNTOWN
AND AIRLAKE REDEVELOPMENT
PROJECTS, AND MODIFICATION OF TAX
INCREMENT FINANCING DISTRICTS.
LOCATED WITHIN THE REDEVELOPMENT
PROJECTS AND APPROVING -AND
ADOPTING MODIFIED REDEVELOPMENT
PLANS AND TAX INCREMENT
FINANCING PLANS RELATING THERETO.
WHEREAS, The Housing and Redevelopment Authority in and for
• the City of Lakeville, Minnesota (the "Authority") and the City of Lakeville,
Minnesota (the "City"), established the Downtown Redevelopment Project in
1980 and established the Airlake Redevelopment Project in 1984 (the
"Projects") pursuant to Minesota Statutes, Sections 469.001 to 469.047,
inclusive, as amended.
WHEREAS, the Authority and the City also established Tax Increment
Financing District No. 1 as a "redevelopment district" within the Downtown
_ Redevelopment Project and Tax Increment Financing District No. 4 as an
"economic development district" within the Airlake Redevelopment Project
(the "Districts"), pursuant to Minnesota Statutes, Sections 469.174 to 469.179,
inclusive, as amended.
WHEREAS, the Authority has now prepared the following .documents
(the "Modified Plans"):
(a) Downtown Redevelopment Project Plan-Modification No. 2;
(b) Tax Increment District No. 1 Tax Increment Financing Plan-
Modification No. 2;
(c) Airlake Redevelopment Project Plan-Modification. No. 1; and
• (d) Tax Increment District No. 4 Tax Increment Financin Plan-

Modification No. 1;
WHERAS, the Modified Plans basically amend the budget portions of
the Project Plans and Tax Increment Financing Plans so as to permit the
expenditure of tax increments derived from the Districts to finance major
storm sewer improvements of benefit to the respective Projects;
WHEREAS, the Authority has approved the Modified Plans pursuant
to and in accordance with Minnesota Statutes, Sections 469.001 to 469.047 and
Sections 469.174 to 469.179, inclusive, as amended;
WHEREAS, the City Council of the City (the "Council") on the date
hereof held a public hearing regarding approval of the Modified Plans, for
which hearing notice was published in a newspaper of general circulation in
the City not less than 10 or more than 30 days prior to the date hereof; and
WHEREAS, the Authority has submitted the Modified Plans to the
County Board of Commissioners for Dakota County and the school board of
the school district in which the Districts are located and has notified such
County Board and such school boards that the modification of the Districts
• and the Projects will be considered at this meeting;
WHEREAS, the Authority and the City have performed all actions
required by law to be performed prior to the approval and adoption of the
Modified Plans;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF LAKEVILLE, MINNESOTA, as follows:
1. The findings contained in the original tax increment financing plans
establishing the Districts as a redevelopment district and an economic
development district, respectively, are hereby confirmed.
2. The proposed storm sewer improvements discussed in the Modified
Plans would not, in the opinion of the Council, occur in the reasonably
forseeable future through private investment, and the use of tax increment to
assist such improvements is determined to be necessary since payment for
such improvements solely through special district taxes or special
assessments would place an undue burden on existing development and
discourage the development and redevelopment of property in the Projects.

• 3. The Modified Plans conform to the general plan for the
development or redevelopment of the City as a whole and. have been
reviewed by the planning commission.
4. The Modified Plans will afford maximum opportunity, consistent
with the sound needs of the City as a whole, for development of the Projects
by private enterprise by providing an essential inftrastructure improvement
needed to spur development in the Projects.
5. The Modified Plans are hereby approved and adopted by the City in
substantially the form on file with the City on this date.
6. The City Administrator is authorized and directed to take all action
on behalf of the City, subject to such approval of this Council as is required by
law, to implement the Modified Plans.
7. The Authority is authorized and directed to take all actions
necessary to implement and carry out the Modified Plans.
