NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Lakeville: The Findings of Fact and Conclusion attached hereto as Exhibit "A" are adopted by the Lakeville City Council. Zaun, or TEST: Charlene Friedges, City erk • FINDINGS OF FACT AND CONCLUSION REGARDING PETITION FOR AN ENVIRONMENTAL ASSESSMENT WORKSHEET FOR THE PROPOSED LAKE VILLA GOLF ESTATES 6TH ADDITION 1. PROJECT DESCRIPTION The proposed project consists of a 30 lot single-family plat with sanitary sewer, storm sewer, watermain, and street construction. 2. ENVIRONMENTAL ASSESSMENT WORKSHEET PETITION The Environmental Quality Board has forwarded. to the City a petition for the preparation of an Environmental Assessment Worksheet ("EAW") for the project. The City has reviewed the petition in accordance with Minnesota Rules Section 4410.1100, Subp. 6. 3. CRITERIA The City is required to order the preparation of an EAW if the evidence presented by the petitioners, proposers, or other persons or otherwise known to the City demonstrates that, because of the nature or location of the proposed project, the project may have the • potential for significant environmental effects. 4. ANALYSIS OF PETITION The EAW petition lists concerns that the petitioners believe establish the need for preparation of an EAW. The stated concerns and the City's response to them are: A. Problems Associated with Grading, Filling, Drainage, and Flooding. Before any construction takes place, a grading and erosion control plan will be prepared and approved by the City and the Dakota County Soil and Water Conservation District. This plan will fully address the concerns and protect the environment. B. Loss of Trees and Wildlife. It is impossible to develop property without loss of some trees and without disturbing wildlife. A professional forester has visited the site and identified trees that must be preserved. Every effort will be made to protect as many trees as possible. CONCLUSION • The evidence presented fails to demonstrate that the project may have the potential for significant environmental effects. The petition for preparation of an Environmental Assessment Worksheet is denied.
