NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Lakeville: The Findings of Fact and Conclusion attached hereto as • Exhibit "A" are adopted by the Lakeville City Council. Za , Mayor AT~'E r atrick McGa ey, Administrator/Clerk • FINDINGS OF FACT ORCHARD LAKE HILLS ADDITION ENVIRONMENTAL ASSESSMENT WORRSHEET PROJECT DESCRIPTION The proposed project consists of a 26 lot single-family plat with sanitary sewer, storm sewer, watermain, and street construction. PETITION FOR AN ENVIRONMENTAL ASSESSMENT WORKSHEET The City of Lakeville received a Petition forwarded to it from the State Environmental. Quality Board requesting that an Environmental Assessment Worksheet (EAW) be prepared for the proposed ORCHARD LAKE HILLS plat. The Natural Resources Committee reviewed the Petition at a regularly scheduled meeting on June 21, 1988. The Dakota County Soil and Water Conservation District also reviewed the request and by letter dated June 21, 1988, forwarded a recommendation to the City. The Dakota County Soil and Water Conservation District. and the Natural Resources Committee both recommended against the preparation of an EAW. • CRITERIA The preparation of an EAW for the proposal is neither mandatory nor exempted. Minnesota Rules § 4410.1100, subd. 6, provides: The RGU shall order the preparation of an EAW. if the evidence presented by the petitioners, proposers, and other persons or otherwise known to the RGU demonstrates that, because of the nature or .location of the proposed project, the project may have the potential for significant environmental effects. The RGU shall deny the petition if the evidence presented fails to demonstrate the project may have the potential for significant environmental effects. The RGU shall maintain, either as a separate document or contained within the records of the RGU, a record, including specific findings of fact, of its decision on the need for an EAW. SPECIFIC FINDINGS 1. The preparation of an EAW for the project will not: a. Present additional environmental information. b. Interpret the existing information any differently than. • already done. c. Significantly alter the layout of the project. 2. The project does not have a potential for significant. environmental effects because of the mitigation measures and controls that will be imposed on the project. CONCLUSION The City of Lakeville, acting as the responsible governmental unit, concludes that the preparation of an environmental assessment worksheet is not needed and will not be ordered. • •
