HomeMy WebLinkAbout88-027 - CITY OF LAKEVILLE DAKOTA COUNTY, MINNESOTA RESOLUTION Date April 4, 1988 Resolution No. 88-27 Motion By Enright Seconded BY Sindt RESOLUTION ADOPTING FINDINGS OF•FACT AND CONCLUSION REGARDING THE LAREVILLE COMMERCIAL CENTER ENVIRONMENTAL ASSESSMENT WORKSHEET WHEREAS, the City of Lakeville, as the responsible govern- mental-unit,-has directed the .preparation of an Environmental Assessment Worksheet ("EAW") before granting final approval for the Lakeville Commercial Center; and WHEREAS, the City has received and reviewed the EAW and has forwarded it for comment to various. groups, organizations, and individuals as required by law; and. WHEREAS, the Notice of Availability for Review was published in the EQB Monitor on February 22, 1988; and WHEREAS, the thirty (30) day comment period has closed; and WHEREAS, the City Council has received and considered letters and other comments on the EAW. NOW .THEREFORE, BE IT .RESOLVED by the City Council of .the City of Lakeville: The Findings of Fact. and Conclusion attached hereto as Exhibit "A" are adopted by the Lakeville .City Council. .Adopted by :thee City Council of the. WORKSHEET PROJECT DESCRIPTION The proposed project consists of sanitary sewer, storm sewer, watermain, and street construction. serving 16 commercial lots. As envisioned, the project would be developed over two or more years with eventually up to 150 medium-density residential units added in an area ~ currently proposed as--an outlet.. Figure 2 illustrates the total project area. At present, no plans exist for actual commercial. building or residential construction. ENVIRONMENTAL ASSESSMENT WORRSHEET PREPARATION AND DISTRIBUTION The City of Lakeville prepared an .Environmental Assessment Work- sheet (EAW) for the Lakeville Commercial Center, pursuant to the rules of the Minnesota Environmental Review Program. The EAW was distributed to all persons on the Minnesota Environ- mental Review Program distribution list, the notice of availability • .for review was published in the EQB Monitor on February 22, 1988, and the RGU provided a press release to a local newspaper. The Natural Resources Committee conducted a public informational review. of the EAW on February 2, 1988. The thirty (30) day comment period ended on March 23, 1988. CRITERIA 1. Type, extent and reversibility of environmental impacts: The EAW describes the project and analyzes the possible environmental impacts associated with the project. The results of this .analysis are that no irreversible adverse impacts will occur. as aresult of this project. 2. Cumulative potential effects of related or anticipated future projects: No related projects are planned as part. of this project. 3. Extent to which the environmental effects are subject to mtiga- ton by ongoing public regulatory authority.: The .Department of Health, Minnesota Department of Natural • Resources, .the Minnesota Pollution Control.Agency, and, possibly the Department of the Army, Corps of Engineers will Y • maintain ongoing authority over the project as a result of permit applications. 4. Extent to which environmental effects can be_anticipated and controlled as a result of other environmental studies undertaken by public agencies or the project proposer, ar of EIS's previously prepared on similar projects: No similar environmental. studies have been undertaken in- Lakeville. ' COMMENTS _ Six (6) letters were .received in comment to the EAW or the project . 1. Minnesota Historical Society, January 29, 1988. - This letter contained no comments or questions. requiring a response. 2. Metropolitan Council, February 8, 1988 and March 15, 1988. The letters contained no comments-or questions requiring a response. 3. Minnesota Environmental Quality Board, February 17, 1988.- The letter .contained no comments or questions requiring a response. 4: Minnesota Department of Natural Resources, February 29, 1988. The letter states that measures should be taken to mitigate the loss of Type 3 Wetlands. Pondng will be provided in the Type.2 Wetland which mitigates the .loss of the Type 3 Wetland. It will also replace in part the loss of wildlife habitation. 4. Minnesota Pollution Control Agency, February 19, 1988. The letter states that further evaluation for adverse-:effects on the water quality of Lake Marion should be made to more_ accurately assess existing and future phosphorus loadings. Such a study will be undertaken. The. letter further states that a different phosphorus model should be used. We agree. The suggested model will be used. The final suggestion is. that certain specified design critera be used for detention ponds. The critera .they suggest .will be used. 5. Department of the Army, Cor s of Engineers, February 9, 1988. The letter states that a permit is required from the Corps_of .Engineers. A permit application will be filed. r ~ k r CONCLUSION The City of Lakeville, acting as the responsible governmental unit, makes a negative declaration, The proposed project does not require the preparation of an environmental. impact statement..
