RESOLUTION REGARDING
MEADOWS WEST IMPROVEMENT PROJECT 86-8
WHEREAS, the City and Jack Lankas Construction, Inc.
("Developer") entered into a Development Contract and Planned
Unit Development Conditional Use Permit dated May 21,.1984 ("Con-
tract"); and
WHEREAS, the Developer is entitled to a refund of
$12,520.00 under paragraph 15 of the Contract which is calculated
as follows:
$ 34,573.00 Connection Charge
- 41,093.00 Storm Sewer Trunk in Plat
- 6,000.00 Market Value of 1.497 Acre Pond
$ 12,520.00
AND WHEREAS, the Developer breached the Contract by
failing to complete construction of a street; and
WHEREAS, the cost of completing the street projec t
is in excess of $12,520.00; and
WHEREAS, pursuant to the Contract the Developer is
indebted to the City for the cost of completing the street.
NOW THEREFORE, be it resolved by the Lakeville City
Council:
1. The $12,520.00 refund due the Developer under paragraph
15 of the Contract shall be used to satisfy the Developer's obli-
• gation to pay for the Meadows West Improvement Project 86-8.

• 2. The City's financial director is instructed to
make the appropriate fund transfers to implement this Resolution.
