.BOARD OF REVIEW
APRIL 11, 1995
The meeting was called to order by Acting Mayor Sindt at 7:00. p.m. Roll call
was taken. Present: Councilmembers Johnson,. Sindt and Harvey. Absent:
Mayor Zaun and Councilmember Mulvihill
Also present:. B. Erickson, City Administrator; J. Walston, Assistant City.
Attorney; D. Feller, Finance Director; C. Friedges, City Clerk.
Mr. Feller provided an overview of the property tax structure and the method by
which property taxes are calculated. He explained that the major factors that
determine property taxes are:
• Market Value
• Tax capacity class rate and resulting tax capacity value
• Tax capacity rate and resulting property taxes
He went on to explain that the. entities involved in determining the City of
Lakeville's tax capacity rate are:
• School Districts (58.4%)
• Dakota County (22..5%)
• City of Lakeville .(17.6%}
• Miscellaneous, i.e. Metropolitan Council Mosquito Control (1.5°~)
Mr. Feller explained that the State of Minnesota offers a property tax refund to
renters who have household incomes of less than $35,000 and homeowners
who have household incomes of less than $60,000. Property owners are also
entitled to a property tax refund if their taxes have increased by more than
12%.
Mr. Marvin Pulju, Dakota. County Assessor, explained that the assessor's office
is responsible for determining 1995. property valuations, based on current
market conditions, for taxes payable in 1996. Property sales from the period of
October 1, 1993,. to September 30, 1994, were analyzed and considered in
making the 1995 assessment. He explained that the. County uses a Computer
Aided Mass Appraisal (CAMA) system to calculate the market value based on
the property's physical characteristics and. other factors, such as market
(sales) trends. The estimated market value should be very close to the amount
the property would sell for if .placed on the open market. He explained that the
State Board of Equalization requires the median value of assessment to be
between 90% and 105°~ of market value. Lakeville's median values are at

95% of market value. Mr. Pulju pointed out that the average increase in
market value for residential property in the City of Lakeville is approximately
7.3%.
Mr. Pulju stated 251. Lakeville residents attended the Open Book meetings
held in March. A majority of the appraisal inspections scheduled at the Open
Book meetings have been completed by the County's appraisal staff. He
explained that if-residents'in attendance have questions about their valuations,
they are invited to meet individually with the appraisers this evening.
Acting Mayor Sindt opened the meeting to general questions and comments.
Mr. Vincent Giorgi, 1.7733 Kingsway Path, requested that the assessors office
make the same data available at the Open Book meetings held at the Western
Service Center in Apple Valley as is available at the assessor's office in
Hastings.
A resident questioned the inconsistency of the valuation on his home, which
went up in 1991-92 and then came back down in following years. Staff
• explained that the inconsistency could have been the result of human error,
and urged him to discuss his situation with an appraiser to verify that the
information in the County's computer is accurate.
At this time, the County Assessor's staff began meeting individually with
property owners in attendance:.
The City Council considered the application of JDS Holdings, Inc. and
Aberdeen Real-Estate Partnership,. Inc. for anon-safe and Sunday liquor
license at Towers Restaurant & Lounge. Mr. Erickson explained that per staff

request, Aberdeen Real Estate Partnership, the property owner, has. agreed to
be co-applicants for the liquor license with the restaurant and lounge tenant,
JDS Holdings, Inc. He stated additional. information on the Liquor license
application will be available for -the Council's review prior to the May 1st public
hearing.
95.54 Motion was made by Johnson, seconded by Harvey to receive the application
of JDS Holdings, Inc. and Aberdeen Real-Estate Partnership, Inc. for an on-
sale and. Sunday liquor license at Towers Restaurant & Lounge, and call a
publicfiearing for May 1, 1995.

Acting Mayor Sindt recessed the meeting at 7:35 p.m. and reconvened the
meeting at 8:30 p.m.
Mr. Pulju reported that his staff met individually with 58 residents to review
their property valuations. Of these, 20 on-site inspections were scheduled.
He stated that in addition to the 20 scheduled inspections, his staff will be
contacting thoseproperty ownerswho appealed their assessment in writing,
and will report the results to he Board of Review when it reconvenes.
The City Council agreed to reconvene the Board of Review meeting on
Monday, May 1st.
95.55 Motion was made by Harvey, seconded by Johnson to receive letters from the
