RESOLUTION ADOPTING ASSESSMENT FOR
LAKEVILLE 2ND ADDITION
STORM SEWER CHARGES
WHEREAS, pursuant to proper notice duly given as required by law,
the council has met, heard and passed upon all objections to the
proposed assessment for storm sewer charges for Lake Vale 2nd Addition;
and
• WHEREAS, Section lU of the development contract states, "The
~ Developer shall pay a storm sewer charge for the plat of $12,883.11 in
lieu of the property, paying a like assessment at a later date. The
charge shall be assessed against the property in Phase I over a lU-year
period with lU% interest on the unpaid balance.", and, "The developer
shall be given a credit for the fair market value of Outlot "B" against
the storm sewer charge based upon the land's fair market value as
mutually agreed or if there is no agreement, based upon a value deter-
mined by an appraiser selected by the City."; and
WHEREAS, the value of Outlot "B" is determined to be $7,512.
NOW, THEREFORE, BE IT RESOLVED by the City Council of Lakeville,
Minnesota:
1. Such proposed assessment No. in the amount of $5,371.UU, a
copy of which is attached hereto and made a part hereof, is hereby
- accepted. and shall constitute the special assessment against he
lands named therein, and each tract of land therein included is
hereby found to be benefited by the proposed improvement in the
amount of the assessment levied against it.
2. Such assessment shall be payable in equal annual installments
extending over a period of lU years. The assessment shall bear
interest at the rate of lU.UU percent per annum. To each subsequent
installment when due shall be added interest for one year on all
unpaid installments.
3. The owner of any property so assessed may pay to the city treasurer
the entire amount of the assessment remaining unpaid, with interest
accrued to December 31 of the year in which such payment is made.
Such payment must be made before October 15, or interest will be
charged through December 31 of the next succeeding year.
4. The clerk shall forthwith transmit a certified duplicate of this
assessment to the county auditor to be extended on the proper tax
lists of the county, and such assessments shall be collected and
paid over in the same manner as other municipal taxes.
ADOPTED by the City Council of the City of Lakeville, Minnesota,
this 1st day of July, 1985.
