RESOLUTION ORDERING STORM DRAINAGE PROJECT N0.>;83-11
AUTHORIZING THE PREPARATION OF PLANS AND SPECIFICATIONS
AND SETTING POLICY ON THE ASSESSMENT OF THE PROJECT COSTS
WHEREAS, the City Council has received a preliminary engineering
report dated April 20, 1984, on the proposal to install a storm drainage
pipe on the west side of Jacquard Avenue between 210th and 208th
Streets; and
WHEREAS, the City Council has received reports of ground water
and/or storm drainage that is adversely affecting the private and public
property on the west side of Jacquard Avenue and the street; and
WHEREAS, the proposal from the city engineering consultant to
construct a part of the area storm drainage control. system in a test
area for the purpose of alleviating the ground water disposal problems
of property owners on th west side of Jacquard Avenue and. preserving the
recently improved Jacquard Avenue street is deemed to be in the public
interest.
NOW,. THEREFORE, BE IT RESOLVED:
1. That the Jacquard Avenue storm drainage project No. 83.-~,~, is hereby
ordered and Consulting Engineers Diversified is authorized and
directed to prepare plans and specifications.
2. The City Council hereby establishes the policy as follows for the
assessment, deferment and abatement of assessments on this test
project.
A. The project area of benefit will be assessed $1,775.00 per each
lot of record, or for undeveloped property capable of meeting
minimum lot requirements, which can legally accommodate a
house.
B. The assessment hearing will be held by October 10, 1984; and the
assessment will be levied after the assessment hearing is
closed, with the assessment to be deferred until September 30,
1985, without interest.
3. The City Council will activate the assessment on or before October
10, 1985, if the project is determined to be effective in collecting
ground water previously conveyed onto Jacquard Avenue.
4. Property owners will have the option of paying the principal of the
assessment in full, without interest, within thirty (30) days after
the council meeting at which the City Council ends the deferment
period and adopts the assessment.
5. If the City Council determines that the project does not effectively
and substantially collect ground water from the property on the west
side of Jacquard Avenue between 210th and 208th Streets and convey
it to the present drainage ditch near 208th Street, and thereby
prevent damage to the base and surface of Jacquard Avenue, the
assessments shall be abated by the City council in full for this
project.
APPROVED AND ADOPTED by the City Council of the City of Lakeville,
Minnesota, this 4th day of June , 1984.
